The Supreme Court will rule it is the Senate’s job to determine if Obama meets the eligibility requirement of the Constitution.

If they make that determination, they'll simply allow the previous court ruling to stand and everyone will be left guessing what to do next.

And in private, two or three of the justices will giggle a little as they think about that.

Or, what night happen is that we'll get four votes today, and in the emergency hearing that will be ordered for next week, they will vote to send the case back and order the lower court to require Obama to produce the document by a date certain.

Ten days might not be enough time to get it all done. I don't think they can order the Electoral College to delay its vote, so we might actually see the 20th Amendment come into play.

So, what is about to happen will be either maddening and frustrating, or exciting and interesting.

Even though The Messiah is the president-select, he shouldn’t be given any more special treatment than you, me, and the cat down the street. The One is a recently resigned junior senator from Illinois. He ISN’T the president.....yet. I pray the SCOTUS will look at him as much and DO THE RIGHT THING. This is one of the most important case before the SCOTUS in a long time. Rule accordingly.

I’m guessing that if Obama is declared ineligible, Biden would become president-elect. It’s a bit like if a winning candidate dies immediately before an election or between winning and inauguration—the opposition candidate does not win by default.

It’s interesting that the spokespeople of the Right are out saying this is crazy.

If it’s all so crazy, just release the original certificate and be done with this.

Why aren’t any of the spokespeople on the Right suggesting that?

The Media has been suppressing the threat, and it is a credible threat, by preventing the issue from taking center stage and becoming volatile, but it isn’t enough to destroy this country.

To be sure there could be the worst riots ever fueled by Members of the Nation of Islam burning down Black Churches and businesses to create riot in black neighborhoods as they have done in the past, but it can be stopped and will be.

He is not technically the president elect yet. The electors don’t cast their votes until Dec 15...and I think the votes are tallied by congress in January.

Even after that, if he is proved ineligible, I would be stunned if Roberts would swear him in.

I don’t believe any of it. I cannot believe that the highest office in this land would not be vetted by Congress and SCOTUS.

Think about it. Even if Democrats are flaming leftists bent on destroying the Constitution, to pull something like this is begging the American people to rise up and demand recall elections on every Democrat politician in Washington who supported Obama.

It is a recipe for changing affirmative action laws, labor laws, ACLU funding, PBS funding and everything leftist in this country that is supported by government.

It would be a cause to change the Constitution to demand term limits.

Hmmm... We can only hope.

Mark Levin is a constitutional scholar who wrote the book Man in Black. He hosts a syndicated radio show. He is on after Hannity. You can listen to him on WABC. Brilliant mind.

And in this case, unless the issue is raised by the senate to ask the Supremes for guidance, the US Supreme will not take a position.

And in that scenario the Supreme Court would still not take a position. The court cannot issue an advisory ruling, the cannot tell the Senate that an act they are about to take is unconstitutional. The court can only rule on matters that are brought before it. And it doesn't look like the Donofrio case will be one of them.
