NEW YORK A New York man is being sued for trademark infringement after he towed a 25-foot-long fake missile around Manhattan with the words "Viva Viagra" printed in blue on its sides.
An attorney for Viagra-maker Pfizer Inc. says that the man's use of the company's logo could confuse consumers into thinking the rocket was an actual advertisement for the drug used to treat male impotence.
But 48-year-old Arye Sachs of West Babylon says no one would be deterred from buying the blue pills because of he what he did. He says he knows because he's a "customer."

How would it be trademark infringement if he’s not using it for profit?
I wonder what Pfizer would do if I got Viagra tattooed onto my rocket? There would be NO WAY IN TEXAS to remove it: not while I live and breathe anyrate!

Sachs, from West Babylon, said cops just laughed as he passed through the Queens Midtown Tunnel on his way into the city Sept. 8.
Sachs also claimed he drove his “missile” through the Lincoln Tunnel five times, and was only stopped twice.
“They checked license and registration, but not the missile,” he said.
“You’re telling me that when you drove up to the Lincoln Tunnel -” Pauley said.
“They saluted,” said Sachs, who is representing himself in court.
Sounds like good business to me!

West Babylon, on the south shore of Long Island, is also the hometown of Geraldo Riviera and Jessica Hahn from “PTL Club” fame.
I used to visit that town all the time when I was a kid....my grandparents, aunts, uncles and eight cousins all lived there at that time.
He's been driving this thing all over the place, including to a sex expo, possibly giving the impression that the makers of Viagra support the advertisement. Trademark gives you the right to determine how your logo is used, with certain exceptions. He loses.
OTOH, it's a heavy handed for the company to sue for any damages. A simple agreement to remove the logo, or an injunction forcing him to do it, should have been enough.
