Being that Gov. Palin is not the owner of the server that was violated she is not the victim of a crime. Instead, Yahoo is that one that is the victim and they should pursue charges against the hackers.
So, Yahoo! goes for criminal and Palin et. al. go for civil.
Yahoo and other Internet email providers promise security as part of the package. Sure I know how frail that promise is, but they promise it nevertheless. Individuals expect competency from these providers. They are indeed victims beyond Yahoo, and are themselves violated. They should have expectation of redress.
I disagree. Yes, they 'broke' into the Yahoo server, but what they took was Palin's private coorespondence so they are both victims. Beyond that, it is a felony. It really does not matter who the victim is or what the victim thinks.

IMO, your interpretation is limited far more than the actual law itself. Her privacy has been violated and she, and her family members, could have a civil case that might award damages, of they wanted to pursue it.
The break-in, if you would, involves Yahoo, but the dissemination of her Emails and photos and the other information, directly involves her and her family.
So, in a short phrase, you are wrong.
