And what if a state joined the confederacy and allowed the CSA army to occupy into its territory before formally ratifying its act of secession? If you believe unilateral secession is somehow constitutional, you must also admit then that Virginia violated the constitution by allowing "foreign troops" on it's soil before it had even had a vote on the secession question.

You are assuming that a plebiscite is required, before a State may secede. Upon what do you base that assumption?
