A judge this morning granted a divorce to a Knox County man accused of killing his student-teacher wife's teenage lover.
Fourth Circuit Court Judge Bill Swann actually spent little time deciding that Eric McLean was entitled to a divorce. Estranged wife Erin McLean didn't show up for court.
Her whereabouts are unknown.
However, Swann said he was "greatly concerned" about the welfare of the McLeans' two boys, ages 11 and 8.
Eric McLean hasn't seen the boys since the day before he was accused of fatally shooting 18-year-old Sean Powell outside the McLeans' Coker Avenue home in March.
Testimony showed that Erin McLean fled her mother's home in Nashville with the children late last year and has since been moving with them from state to state and may be in the company of another young man she met over the Internet.
"We don't know where they are," Swann said of the children. "She's not here. She's left us in the dark."
Swann appointed attorney Lisa Wright to serve as guardian ad litem or legal caretaker for the children.
"We will actively search for these children," Swann said.
Swann delayed giving final approval to any permanent plan for the children's custody until Wright has time to try to find them and determine what's in their best interest.
Eric McLean said after the hearing that he continues to struggle with worry over the children.
"It's been horrible," he said. "I just hope we can eventually get them back to a safe place. This is a big first step."
McLean was an aspiring music teacher when he learned his wife, then a student teacher at West, had embarked on a sexual relationship with Powell, who attended her class at West.
Powell was fatally shot, allegedly by Eric McLean with a high-powered rifle borrowed from a friend after months spent trying to woo his wife back, even allowing Powell to accompany the couple on outings.
Attorney Bruce Poston has contended Eric McLean acted in the heat of passion during a seven-minute period between the time he reported Powell to authorities as an intruder and the shooting.
A Knox County grand jury indicted McLean on a second-degree murder charge, rejecting a first-degree indictment.
Assistant District Attorney General Bill Crabtree, however, presented the charge in December to a second grand jury, which returned a first-degree murder indictment.

Was she a student or a teacher? And the victim - was he the teacher’s student? Or was he the student-lover?

What in the hell is wrong with men these days? Going on outings with your wifes punk lover?
She was a teacher, after her husband shot the kid, she went to the university and had her transcript changes to her maiden name. Applied to be a teacher in another location and got caught having sex with another student. Current location unknown. But she has run out of names to hide her sex offender class as a teacher, maybe.
