This is a really sad story all around. Firstly it looks like she was planning on having the baby. She miscarried a tiny baby who had died in the womb. The dead baby was wrapped in sheets and mistakenly put with the laundry. I can see the trauma for the parents but have to say that it wasn’t done intentionally. They didn’t cause the death of the baby. Lawyers are the first ones called when any mistake is made.

FYI: aborted babies are sent to a lab for documentation and then discarded. I have worked in labs and have seen aborted babies that had to have been in the late second trimester. These babies are fully formed, just small. It is overwhelmingly sad. Doctors who send mid-term babies are usually reported to the state.

No, that is incorrect. Let me give you an example that might show you your error in thinking.

Let's say that a person driving a car that malfunctions runs into you, damaging to your vehicle, severely injuring you, as well as killing your children.

Their insurance company offers to repair your car, and pay some of your medical expenses (you had pre-existing conditions that exacerbated your recovery, so they won't pay everything), but that's it. The auto maker's insurance company laughs at you.

Do you sue them, or let it drop? Remember, you haven't yet proven that anyone did anything knowingly or recklessly.

Still think your definition of the reasons for filing lawsuits is correct?

BTW, lawsuits are not for punishing anyone. They are for recovering damages from those who refuse to allow recovery of those damages. Some damages cannot be recovered (the lives of your children, the pain and suffering from your injuries) and so the court system attempts to quantify them in financial terms, so you receive money instead of the unrecoverable.

Dallas attorney Michael Stewart, who is representing Huguley, denied the allegations and said the hospital did nothing inappropriate.

If the auto maker laughed and denied any responsibility, a lawsuit would be appropriate. The design and safety of a consumer product is different than what happened in this case.

Listen, I never said that the parents were not entitled to compensation from the hospital for their mental anguish. What the hospital did was wrong and it caused emotional pain.

I believe that these parents have probably been offered a settlement or two from the hospital. Insurance companies like to make this stuff go away shy of a lawsuit being filed. In my opinion, and my opinion only, these people are looking for a lottery payday from this case. That is what this country is all about these days.

A sincere apology and payment for actual damages is a thing of the distant past.

The Huguley Memorial Medical Center of Fort Worth staff took 19 hours to find the missing body, which was unpreserved and by then had been crushed and disfigured, according to the lawsuit filed Tuesday.

That is a huge ugly medical center.

An acquaintance who worked in a hospital told me that dead bodies were removed to the hospital morgue on a cart, disguised as a pile of laundry. In the case of a small baby, perhaps this could sometimes get mixed up with real laundry.

I have. Both times, it bore no resemblance to the actual situation and the actions that had taken place. Negotiating was like talking to a brick wall.

No, a lawsuit is the only solution in those cases.

And the point is, your definition of when a lawsuit is called for needs to be modified. True?

I’m not modifying anything to suit an agenda that you have against hospitals and/or insurance companies. I don’t believe that a lawsuit is the answer every time someone’s expectations are not met.

I've been in Louisiana twice, and I truly love the place.

Come on down then! A bit chilly right now, but will be around 70 by Monday (ugh). Louisiana gets a bad rap because of the democrat population in five cities, but overall it is a great place. Great food, friendly folks, pretty landscape in many areas and lots of things to do outdoors. Glad to hear that you like it too.

Yes, it’s true. When a patient dies a gurney is brought to the room. It is a two shelf gurney and the body is placed on the lower shelf. Then a drape is placed on the flat top of the gurney and it flows over and covers the lower shelf. This is the only way to transport a dead patient from the hospital floors with no one the wiser.

Apparently, with you, it does. You are the one claiming to have all of the experience with hospitals and insurance companies. And, you are the one that has determined that they are all out to cheat claimants.

My mind is made up that everything in life doesn't have to be settled with a lawsuit. That is not an unreasonable position. Everyone that thinks they are entitled to a lottery-type payoff is not necessarily correct in their thinking.
