Marine's possible flight to Mexico complicates case

"...Laurean was born in Mexico and maintains several Spanish aliases. He became a U.S. citizen in 2003 and was living in Las Vegas, Nev., before enlisting in the Marines a year later, according to Marine Corps officials and FBI reports.

Laurean likely sacrificed any citizenship rights he maintained in Mexico when he joined the Marine Corps, but that's an untested question in Mexico, Ornelas said.

The FBI is feeding investigators in Mexico tips about Laurean's possible whereabouts and asking them to check on the FBI's behalf, said Newsom Summerlin, FBI special agent in Charlotte.

Laurean also faces a federal flight charge, according to FBI officials. Meanwhile, Marine Corps investigators have asked to perform an independent autopsy of Lauterbach and her fetus, said Hudson, the DA. Nothing bars the military from trying Laurean for murder. State and military prosecutors typically avoid duplication though, said Scott Silliman, a Duke law professor and expert in military law.

If tried in the military system, Laurean could also face a murder charge for the death of Lauterbach's baby. North Carolina doesn't have a law prohibiting the killing of an unborn child, but the Marine Corps can charge him for the baby's death..."
