To support its claim, the city notes that the Cherry Pit accepts money from guests and promotes the parties on its Web site.

Accepts money, or requires money? I accept beer or pizza money from my friends when they come over to watch a football game.

If they're running an unlicensed business, then shut 'em down on that basis. If this is a problem with noise or tangibly disrupting the neighborhood, then shut 'em down on those grounds.

But since when do homeowners have to get permission from the city for whatever crazy (or stupid) stuff they want to do in the privacy of that home?

Agreed. If he's charging admission, then he's running a business.

If he's not, then he isn't. Simple as that.

In the New And Improved America Lite they do.
