Judge Reprimands Howard K. Stern for Violating Court Order”

Jurors in the Houston Probate Court may have wondered why an attorney for Anna Nicole Smith suddenly began sitting in the audience in the rear of the courtroom instead of with his client and the other attorneys at counsels’ table trying the case. The reason is that Judge Mike Wood became enraged when Stern confessed to the blatantly unethical, fraudulent and unauthorized use of confidential financial documents which were protected by a known, legally binding confidentiality agreement and which Stern pilfered from the courtroom to use in another case. The following is a transcript from the court’s record of an exchange between attorney Howard K. Stern and Judge Mike Wood leading up to Stern’s ban from counsels’ table. The exchange did not go well for Mr. Stern.

“The Court: All right. Mr. Stern, would you come up here, please?

This is on the record, Becky.

[at the bench]

The Court: You filed an affidavit dated October 27th in the [California] bankruptcy proceeding, attaching a copy of allegedly Pierce Marshall’s financial statement. You said you got it from Vickie Marshall’s trial counsel. Who was that?

Mr. Stern: I think I just got it from the [counsels’] table.

The Court: Were you aware that was subject to a confidentiality agreement?

Mr. Stern: It was not marked confidential…

The Court: A confidentiality order – this Court ordered that that document was confidential and could not even be introduced in evidence in this trial.

Mr. Stern: No, I was not aware of that.

The Court: Well, I want you to give your bar information to the Clerk, because I don’t think it’s possible that you could have been here for as much time as you have, with as much argument as there has been about that document, that you would pick it up off the table here and take it and violate this Court’s orders.

Mr. Stern: Okay, Your Honor

The Court: So give the Clerk your bar information. I am going to notify the bar in California, which is all I can do because you are not a member of the bar in this court, and since you are not a member of the bar in this court, you can’t come in front of the bar, because you apparently think it’s possible to pick things up off tables and take them out of here, so just stay behind the bar, if you would.

Mr. Stern: Sure, Your Honor.

Mr. Cunningham (another of Anna Nicole’s attorneys): Your Honor, may I –

The Court: We are in recess until 11:30.”

Stern transmitted the document to California where Bankruptcy Magistrate Samuel L. Bufford reportedly posted the protected document on his website to be viewed by the general public for a period. This incident and others by both Stern and Bufford continue to raise mysteriously unanswered questions about collusion between Anna Nicole’s attorneys and the Bankruptcy court in the California case.

I am going to notify the bar in California, which is all I can do because you are not a member of the bar in this court, and since you are not a member of the bar in this court,

Does anyone know if the CA bar has done anything on this?

Thank you so much. I think this is another example of how devious and dishonest Howard K. Stern is. If he can’t win legally and fair; he’ll lie and steal. Taking those confidential documents was the same as stealing. I hope this little act comes back to bite him bigtime when he goes after the Marshall money.
