Well, the consequences of a the crime may be set in stone, but wouldn’t some discretion come into play as far as whether to even proceed? Obviously there is some, or the girl would be in the same spot?
State police detective made that call. First I knew about it was when I was cooking dinner one evening and he came to to the door to tell me I had to bring my son into troop headquarters to be arrested for indecent exposure. The investigation was completed by then, and when we took him in, we were presented with ‘this is the charge’. He told us the girl wasn’t being charged with anything. We weren’t given any other reason other than he decided not to.
I’ve talked to more than a few people since all this happened and it seems as though charges are more often brought up against males than females, in sex related cases. One counselor told me that when it’s a male (say a teacher for instance with a student) it’s ‘Castrate the bastard’ but if the teacher is female it’s ‘Sure wish *I* had a teacher like that when I was in high school!’ There are a lot of instances of females flashing and nothing is done. Apparently more harm is done seeing male bodies than females???? Dunno. But there is definite bias.
