Possibly, but the child is a far more sympathetic party in a probate hearing than her drug-addled whore mother was. Here's my take on what happens: The Marshall estate settles with Birkhead for a fraction of what was claimed, Stern gets his bills for the last few years paid for and gets to administer the estate (that's the deal that he and Larry made for him to not contest the matter any longer), and Vergie goes away when Birkhead agrees to let her have some visitation.
The baby gets taken care of (at least by nannies, and that's no less than what would have happened if the tramp had survived the OD), Stern gets to make a modest living (and the investigation into his part in the two OD's goes away), Birkhead sells his story for megabucks (let's not forget the pictures, the guy is a photographer) Mamma gets to stick her clutches into the child on a part-time basis, and everybody gets part of what they want. Stories are sold, and finally, the lawyers get paid. Case closed.
