The real star here is Judge Larry Seidlin, who is a trip (to say the least) to watch. His presence on the bench is somewhere between a hard line, "hang 'em high" judge and a stand up (sit down?) comedian.

There was an column posted here a few days back from the Sun Sentinel written by some humorless liberal (are there any other kind?) that had its panties in a bunch over comments some judge made from the bench. A real annoying whine-fest. Was it this judge?

If you really want to understand the situation here and why the excellent texas lawyer is powerless, you must understand Judge Seidlin is looking to force some sort of settlement between the parties. Settlements can not be appealed since all the parties agreed. (absent some form of fraudulent inducement)
What we really have here is a fight over who is going to be able to sell the rights to the funeral and the rights to the open casket pictures.
Folks, these are the trial level judges who populate the courts. This is the level of "working judge" the average citizen has to deal with day in and day out. These are not the rare intelectual elite that occasionally populate the appelate courts or on rare occasion the federal courts.
This is what the Florida Bar, Texas Bar, Georgia Bar, NY Bar, DC Bar does not want you to see when they do their "PROTECT JUDICIAL INDEPENDENCE" programs.
