As has been pointed out elsewhere, the only ethical action Michael Nifong could take in this case was to ask for recusal on the basis of a conflict of interest that had emerged. There is no reasonable way a judge could deny such a recusal, and so the case would get handed off to someone who can handle it reasonably. Since judges and prosecutors aren't supposed to make their decisions based upon blogs and discussion boards, it would likely take the new prosecutor a few days to examine the actual evidence of the case and ascertain that there really truly is absolutely nothing there. I don't know whether the case will last until February 5, but I would be surprised if the case extends past that without a hearing.

Had Nifong recused himself from the case on Feburary 4, it would have been reasonable for the state to ask for an extension while the new prosecutor gets up to speed on the case. But there's enough time between now and February 5 that Nifong should be able to share everything he has (i.e. nothing) and allow adequate time for the prosecutor to prepare.
