Accuser changes story in lacrosse case

"The woman adjusted the timing of the assault to earlier in the evening, a time point preceding the well-documented alibi of one accused player, Reade Seligmann. The defense, however, introduced yet more alibi evidence for Seligmann: he was on the cell phone with his girlfriend during the height of the attack as the accuser now times it."

"* In her latest statement she said the attack ended at midnight.

In previous accounts, the woman said the gang-rape ended shortly before she left in the car driven by Kim Roberts, the second dancer. Roberts called 911 as she was driving away at 12:53 a.m., according to police records. This new account leaves 50 minutes unaccounted between the end of the rape and the departure from the party.

The new statement runs contrary to time stamped photos of the party, which show the two women dancing between 12:00 and 12:04 a.m. in the living room of the house at 610 N. Buchanan Blvd.

* In the latest statement, the woman says she arrived at the party at 11:20 p.m. on March 13 and that the rape began at 11:40 p.m. Her cell phone records show that she was on phone with her father and others up to one minute before the rape allegedly started."

"* The accuser has changed her description of Evans. On April 4, she viewed a photograph of Evans and said it looked like one of her assailants, except that the assailant had a moustache. In the Dec. 21 statement, the woman said the assailant had a five o'clock shadow, not a moustache. Evans has a visible five o'clock shadow in the photograph."

Nifong's trial is set for May 11. He hired an attorney from Winston-Salem to defend him.

Huh? According to the Fongster himself, only the guilty people need lawyers to defend them. What a despicable POS. I hope he ends up in a prison cell. He has repeatedly abused public trust to a level I have rarely seen.

No kidding. Are we supposed to feel sorry for these folks after the relentless spiteful and personal attacks on these students through the spring and summer? Now they are being held accountable and are crying. Spare me. If someone sent a threatening e-mail, notify the police.

By the way, where was Brodhead and Lange last spring when the students were getting beaten up every day by their professors based upon a pack of lies? Duke had nothing good to say about their students then nor did they discourage their faculty from engaging in hate speech. They sure said nothing about the New Black Panthers or the chants and threats at Reade Seligman. I guess that's free speech. Free speech for me dear but not for thee dear.

Some cliches come to mind:

They can dish it out but can't take it.
If you can't stand the heat, stay out of the kitchen.
Wanna play in the big leagues, sometimes you get a brushback pitch.
Children should not play with matches.

Goodness, are these folks full of themslves or what? Sounds like some folks are jealous because they lost the vaunted victim title. Maybe they should think next time before popping their collective mouth.

I managed to read Lange's long essay, but I was left puzzled by one statement. Later, in K.C.'s comment section, I saw that someone else didn't get it either. Lange seems to be talking about two different things. You are so smart, I thought maybe you can tell me what this means:

"The cumulative damage of the months of attacks on some of our faculty and the distress of those who sympathize with them is exceeding the limits of prudence about provoking external reactions."

Strange, Nifong said that one would wonder why if one is innocent and has not been charged with anything, why one would need a lawyer. So why does he need a lawyer? Are the feds up to something?

Yeah, what would he need a lawyer? Well I Jezebelle and I have been debating some all day whether Mangum changed her statement or whether Nifong shaped her statement to fit the evidence. I still think this is a Nifong ploy.

So that is one reason he needs the evidence. And there will be no trial in this case. The NC Bar will disbar him if he has not dropped these charges by his trial date.

I sort of hope if Nifong takes it to the hearing on 5 February that Judge Smith conducts the hearing on the motion, schedules the next hearing for May 15 and then just sits his ruling until after the Bar has disposed of Nifong. Then after that has happened he could toss the ID and bar a tainted in court ID.

Well I was a little shocked by this because Lange did publicly read Houston Baker the riot act. I think Lange did this on orders from Brodhead who had the same complaint in his recent message.

He clearly led her through the toweling her off to try to rehabilitate the inconculsive DNA result on Evans

I thought they disregarded the towel and focused on a possible match on a finger nail. I'm getting confused again.

I (Linwood Wilson) showed (redacted) a picture from the Dan Abrams Show on MSNBC showing her on the porch at the door. Inv. Wilson asked (redacted) when that picture was taken. (redacted) stated the picture was taken when she arrived and was going into the house because it was showing her putting the money in her purse.

Is it just me, but doesn't that wording sound weird? At first, he says, "I" and gives his name, and then the next sentence he says, "Investigator Wilson asked..." It makes it sound like someone else wrote this report, or at least part of it. I wonder if that is a common way to write about an interview in a document. Anybody know?

You are right. I think the inconclusive DNA was on the fake finernail. I think that a towel found in his bathroom on the other side of the house had his DNA and someone elses unrelated to this case. Of course this is Nifong's weak attempt to change the story to make that towell evidence. The problem is where is Mangums DNA on it?

Another site had a link to the typewritten notes of the detective and now they say the rape happened in his bathroom...which happens to be where the all purpose towel was found.

I'm looking for the link.

Nifong has retained counsel. According to WRAL, he is represented by Winston-Salem attorney David Freedman.

That name may sound familiar to folks here who posted during the Abrams Report last spring when Susan Filan suggested that the two defendants (Evans had yet to win the Crystal lottery) were wearing rape jackets. Freedman was also on that panel.

It looks to me like the police got the towel from Dave's bathroom, but that it is not the same bathroom as the one where the alleged attack happened. See item 60 on p. 16. At least, this is how I am interpreting it. Feel free to correct me. I am no expert in criminal matters.

I had not realized that was who he retained. Wow, I guess there were no creditable attorneys left in NC that had not said anything negative about Nifong? Nifong hiring someone that criticized him so much sounds to me like this bulldog we heard some much about has his tail between his hindlegs.
