Duke Lacrosse Accuser Gives Birth

Chapel Hill — WRAL has confirmed that the accuser in the Duke lacrosse case gave birth at UNC Hospitals on Wednesday.

Sources tell WRAL the woman had the baby by Cesarean section. She was not due until February.

There's a well-established legal history for ordering paternity testing in rape cases.

What actually makes the question interesting from a legal perspective now is that the rape charges have been dropped. But I think the defendants are still entitled to the test because she made the allegation and stuck to it until two weeks ago.

For those that don't know he won a lawsuit using junk science to claim that a doc's failure to perform a C-section resulted in the child having cerebral palsy (CP) and dying. During his closing argument he said he was "channeling" the dead child calling out for justice.

In the next year, many OB/Gyns became OB alone, the rate of C-sections skyrocketed, and the incidence of CP - ta da - remained constant. Rather nice statistical experiment that.

NC docs bought air time to oppose him when he ran for president. They NEVER do that.

ABOUT TIME!!

What's significant is that many of the signatories are Assistant Profs which means they are not yet tenured and subject to retaliation at some future date. That takes guts.

RS and DF should return to Duke and declare an Economics major.

Or she can put the kid on welfare, if she hasn't already, and the DA's office will seek paternity testing and child support for the kid as reimbursement of the welfare. Then, when and if she goes off welfare, the support payments will go to her. Even if she doesn't go on welfare, she can still open a case for paternity and support with the DA's office. Welfare or not, she gets a free lawyer and free testing for paternity and establishment of court-ordered support.

Oh, I don't know. Hannity has been on this from the start. He had it out with Lis Weil last night. Greta unabashedly condemns Nifong and says he should be removed from office.

I'm happy to say I don't know how that works.

I do remember a particular DA in California who decided that he would be aggressive in seeking child support from the fathers that new mothers named on the birth certificate. The court mailed (not served, mind you, mailed) the purported fathers with an order to appear in court. Often they were mailed to an incorrect address provided by the mother, or they had moved or an incorrect address was looked up in the directory.

In any event, a large percentage of them failed to appear and thus lost a summary judgment for child support. The first a lot of them found out about it was when their wages were attached. Many of them were able to get a paternity test done and prove that they were not the father. However, having lost in court by not showing up, they were forced to pay child support for some other man's baby.

Sadly, Mike Nifong is not the only one out there.

I believe in this day and age when you can get steak for hamburger prices it's stupid to pay steak prices for hamburger. Therefore the hamburger should be out of a job.

You've gotta be kidding, right? All she would need is a local doctor say the baby may be in danger from the mother's drug use. Right? And there would be no denying that possibility!
