That's why it's called an 'Order' and not a 'request'. Chances are the baby's blood has already been drawn or swab taken. Depends on the nature of the Order & what it will take to give it force.

I recall that Judge Smith characterized the Order as 'contingent'; that is, contingent upon the AV really being pregnant & a baby eventually being born.

I'm curious about the court-ordered paternity test. How can the court order a paternity test unless CGM consents?

Hey R4F, Happy New Year!

On this newly announced birth- could it be that she had a c-section because of a Sexually transmitted disease? She was quite obviously NOT practicing safe sex so could have picked up something easily. If such diseases are active (as in herpes), a baby would be delivered c-section to avoid contamination.

I wonder about that C-section. Partly because of the cost, they're not as routine as they used to be. So it makes me think the baby was either in distress or it's one big mamma jamma.

Beleive it or not, because of John Edwards, yes that one, they are very routine in NC. Thanks to his tireless efforts suing OB-GYNs, any child born vaginally with a birth defect is grounds for a lawsuit against the doc.

My conspiracy theory on the premature birth: The local supporters of the accuser finally figured out that it has already been 9 months since the alleged incident, so they talked her into taking the baby by C-Section to make it appear to be 9 months. Yes, they are that stupid, and they think everyone else is, as well.

I'm sure there's any number of reasons why a C-section was indicated. You mommy types are up on all those, I'm sure.

In any case, that particular channel, shall we say, would certainly not qualify as either Frost's 'The Road Not Taken' or as Peck's 'The Road Less Travelled'! ;>)

I've seen them weigh anywhere between 4-7 lbs depending. That is not counting the growth restricted ones..

I don't know if they are evil :) but they sure don't have much to bitch about if they ply their wares without a pimp to protect them. It's illegal for a reason. Yeah, but he's black and so is she. The boys are white. What's worse in Ted's eyes is that they're not poor or downtrodden. If this case was race-neutral with the boys being black, he'd probably be on their side and be calling Mangum the skanky trash that she is. But skin color overrides all other considerations for many blacks, even blacks who have achieved medium to high levels of success, all of which is why this case should never go to trial, especially not in Durham.

Ted is a racist, plain and simple. Even though there never was a crime committed against Mangum, he still wants these boys to be tried. It's insane. I used to like Ted, but no more. He's shown his true colors, and race loyalty outweighs law and order and the concept of due process in a man who has been thirty years in the business of law. Despicable.

The "channeler" who would be president. Got to build that mansion somehow I guess. These suits have run a lot of gynecologists out of the obstetrics business. And the days of the baby delivering family doctor are long gone.

I guess next he can sue for infection at the incision site.
