In a stunning rebuke to the North Carolina district attorney handling the Duke University rape case, the state bar today filed an ethics complaint against the prosecutor, claiming that he has made numerous press statements that were "prejudicial to the administration of justice" and also "engaged in conduct involving dishonesty, fraud, deceit, or misrepresentation." The North Carolina State Bar's complaint, a copy of which you'll find below, is filled with dozens of comments D.A. Mike Nifong (pictured at right) made following the alleged March rape of a stripper who had performed at a party attended by members of Duke's lacrosse team. The complaint charges that Nifong's comments violated state ethics rules barring statements that "have a substantial likelihood of heightening public condemnation of the accused." Nifong, the complaint adds, should have known that his media statements "had a substantial likelihood of prejudicing the criminal adjudicative proceeding." Criticism of Nifong's handling of the Duke case has increased following his decision last week to drop rape charges against three defendants, while allowing kidnapping and sexual offense counts to stand.
Lawyers are a Fraternity, they dont usually go after each other. Nifong has really screwed up when the Bar Association is out for his blood.
I hope they get it.

When are the defense attorneys in the actual case going to move for sanctions against this jackass for failing to disclose the DNA evidence? If I were the judge, I would pimp slap this guy big time.

Case Might Be Stronger, Law Professor Says
Some experts have said that Nifong's dismissal of the rape charges could actually make the prosecution's case stronger.
"Now, they don't have to establish that there was penetration committed against the accuser," said N.C. Central University law professor Irving Joyner.
"In addition to that, now they don't have to deal with the DNA or the lack of DNA evidence," Joyner added. "And with the rape shield statute, it's unlikely that information will even come before the jury to consider."

He is DEAD wrong. It's all coming in.
And people wonder where the dummies are coming from?
If the judge cared, HE could take care of that himself.
And IMO the defense is laying groundwork for the coming lawsuits -- like "in bibilical proportions," you know?

And from what I am hearing down here, this complaint is the first of "many." As they said on TV last night, wait for the "other shoe" to drop.
The other reports say they opened a file on him on March 30th...........do you believe that, or is that some CYA on the part of the attorneys of N.C.?
But if they did, they certainly gave him enough time to hang himself and, lucky for them, he supplied a boatload of rope.

I'd make it my personal mission to make every day for the next 20-30 years a litigious nightmare for the little pr#ck that tried to railroad my son in order to further his career.
Every day would be "How can I screw Nifong's life?" day. I'd make sure that he spent every penny he has in order to defend himself. I'd make sure that any pension, savings, financial resources be made accessible to civil litigation. Even if they are "shielded" I'd make him spend money defending himself.
In fact Nifong would be my hobby.... every day, all day.
this guy thinks he got away with something, can you imagine what these fathers are gonna do to this little ferret. I'm gonna buy some popcorn and beer.
This will be almost as fun as Hamas and Al-Quida fighting....or the Iran-Iraq war.... or Rosie and Donald...
