Why Amendment 40 might not be such a hot idea[Vanity]

Posted on 11/01/2006 4:39:31 PM PST by ozoneliar

If Amendment 40 passes, it will not only impose limits on all appellate court judges. It will also require the ouster of 5 of Colorado's Supreme Court judges, that means that the next Governor will get to appoint 5 Judges. As I understand Ritter is favored to win. That means a Dem will appoint 5 of the next Supreme Court Judges.

Take the long view, troll. The long view. Good policy is good policy even if it means short term losses.

I think it is fundamentally fine for big changes in the courts to occur, as long as both parties get a turn at this every so often. Stare decisis cuts both ways.

It is better to vote no, IMHO. 5 new Judges = Majority. They can do a lot of damage. Better to table this amendment until conditions are more favorable.

Troll?

Well, I'm not so sure it's a great idea either, but I plan on voting yes. It's not been tried here, so I'm willing to give it a shot. One drawback I have is that the judges, knowing that they will soon be out of office, will be emboldened to make radical decisions.

I assume you feel the same about voting against RINOs, even if the Dems take control of Congress for a term or two?
