The Bar has no valid reason to wait. The steps Liefong has already taken are a done deal. Whether he is elected is irrelevant to their oversight function.
Sure but it is human nature to take your time and see if the problem will solve itself.
I doubt the NC Bar could have had a hearing on this matter by now and taken action against Nifong. As you know there is an investigation, due process right for Nifong etc. They are likely investigating the complaints they have received.
If Nifong is defeated, they can take the far easier actions of sanctioning a private citizen attorney. If Nifong wins, they probably are on track in their investigation.

Dropping the charges against the boys does not exonerate Liefong for his misconduct in bringing them in the first place, nor the identification process he used in this case, nor his unethical statements to the media and other lesser offenses.

I forgot to add that the same holds true as to the election results. A new DA will not take office for a full month or more. Liefong will still be the DA after the election, whether he wins or loses. There's also nothing to stop Easley from re-appointing him, so far as I know, although it would be a stupid political move.
