I haven't read the text of the statute, but yes, in the sense that biometric passports are not the "creation" of the SPP, but rather of the Act.

If the Act is the legislative authorization of a biometric identification system, then in my opinion it's pretty tough to argue that the executive cannot negotiate with other countries to implement them, on the basis that doing so is somehow unconstitutional.

Last time I checked we had representative government in this country. Our representation on these issues is through the congresscritters we elect. Where is their oversight?
