'Sexy substitute' gets no jail time

A female high-school substitute teacher in Utah will serve no time behind bars for performing oral sex on a 17-year-old male student, despite comments from the judge that a man would have likely gone to prison.

"If this was a 29-year-old male and a 17-year-old female, I would be inclined to order some incarceration," noted 3rd District Judge Mark Kouris during sentencing yesterday for Cameo Patch.

Patch was a fill-in instructor at Tooele High School, and was arrested after an informant disclosed her alleged relationship with the boy.

She was put on probation for 36 months, and ordered to obtain a psycho-sexual evaluation, as well as pay a $2,000 fine.

"The only thing I can say is that I understand the mistake that I made," Patch told the judge, according to the Salt Lake Tribune. "It opened my eyes to the life I want to live for myself and my [three] kids. I'll never wind up in this situation again."

She and her husband divorced last month.

Patch and the boy reportedly met in the classroom, but engaged in the alleged wrongdoing off campus after school. All indications are the sexual activity was consensual.

According to the police report, "... [Patch] and the juvenile met in a local restaurant, exchanged phone numbers, and arranged to meet to talk later in the evening. During the course of the meeting between the two, sexual activity between [Patch] and the juvenile occurred."

The informant stated Patch "performed oral sex" on the student, but did not engage in sexual intercourse.

Defense attorney Jon Williams said the boy had "created the environment and invited..."

Damage is relative...some people are more emotionally sensitive than others...yes, I believe boys can be damaged.

I doubt you will find any man on this board (at least one who is honest with himself) who wouldn't have jumped at the opportunity when he was 17 and who wouldn't have suffered any "damage" whatsover . . . .

Guys are different. It's a biological thing. Get over it.

Then take it up with the lawmakers that allow discretion in sentencing, not me.

I personally think they need to sentence all the hottie teachers to Pissant's halfway house for rehab.

a. We've had a few brave souls post on these threads to talk about the damage done to them. One of the reasons it's greater for males are the attitudes expressed on these threads.

Sorta what women used to hear 30 years ago about "if you're raped, just lay back and enjoy it". If they say it was bad, then they're damned for not being a 'man'.

b. I personally know men who've had it happen, and yes, they're scared.

c. My profession is full of trainwrecks of both genders who were created by adults who didn't understand legal or moral sexual boundaries between adults in power/authority and those in their care.

Likewise, there are age-of-consent laws in some states that apply even if the minor victim is still post-pubescent.

And these laws are also different in every state. I think that 17 is fairly common, though. There's a good chance that if she had not been his teacher, that there would've been no violation of the law (this would be true in some states, I believe. Not sure about her state). The fact that she's his teacher is probably the primary thing in this case.

She's hot and the guy was 17 for gawd sakes. When I was 17 I was FAR from a virgin. Plus did I mention she is hot?

And a lot of male pedophiles are studs, rather than drooling nose-pickers. Thank you for voicing the opinion that sexual attractiveness exculpates pedophiles.

The kid is indeed old enough to have a sex drive, but not mature enough to realistically weigh the consequences. That is why we have the term minors the law recognizes that young people are ready for some responsibilities but not all responsibilities. Here's a concept you may have never considered. Maturation occurs gradually and privileges and the accompanying responsibilities are earned incrementally rather than precipitously.

Alright, guys seem to think this is fine and I sort of understand, but why should the punishment differ for men than women. It should be the same across the board for everyone.

I think it's even worse in Louisiana, but then again, Lousiana gave us Ray Nagin, so I suppose it should't be a surprise. Apologies to good Lousisianans.

I don't know what to think about this. The damage done to men is generally underestimated because there is an expectation by society, women, and men themselves that men are supposed to strong and able to deal with such things. And there is a great deal of truth in that.

Also, I don't think these female teachers usually harbor the same ill intent towards their victims that older male teachers do.

There is, however, one factor that trumps all that. I am a firm believe in equal protection under the law, which means the law has to apply equally to everyone, no matter what. The Republic cannot function properly if it does not.

Thanks for posting this. I could see where a 17 year old student would not have the life experiences, etc to know the consequences of his decision. The teacher, on the other hand, was married, had children and was willing to risk all that. Wonder what her kids would think?
