Her spokesman, Elliot Mintz, confirmed the arrest and said police detected the minimum blood-alcohol level to warrant an arrest. The legal limit in California is 0.08 percent. The driving under the influence symptoms were "probably the result of an empty stomach and working all day and being fatigued," Mintz said.
Stupid spokesman. If he was wise he would have said that she was well rested and had eaten earlier. Being exhausted is no excuse for driving drunk--in fact it aggravates the problem. With the spokesman's statement the prosecuting attorney will be able to say that she was less in control of her car than a normal person with a 0.08 BAC.
