HEAR COMMENTS FROM BOONE COUNTY SHERIFF RODNEY MILLER BY CLICKING "LIVE AUDIO" ICON ABOVE.
It appears the 22-year-old man involved in a DUI with death crash in Boone County is an illegal immigrant.
Boone County Sheriff Rodney Miller says Christian Javier Sanchez Rubio of Whitesville couldn't speak English and couldn't produce identification when deputies questioned him early Thursday morning following the deadly crash on Route 3.
Sheriff Miller says Rubio had a resident alien card, but through a translator later admitted the identification was not accurate. Miller says the department is working with immigration authorities on the case. Miller says it appears Rubio was working at mining operations in the area.
Miller says Rubio's status doesn't change much about their criminal case. He says Rubio was drunk when he drove his vehicle across the centerline and slammed into a vehicle being driven by Terry Evans of Clear Fork. Evans' four-year-old son Tyler was killed while a two-year-old son was injured.
Sheriff Miller says the family was driving home to Raleigh County when Rubio came into their path.
Rubio remains a patient at Charleston Area Medical Center. He'll be arrested as soon as he's released.

I'll have ya'll a picture tomorrow Or tuesda..and hope to have a copy of the warrant on tuesday or wednesday..
If that will be enough to suit some freepers..I dunno.
tuesda=tuesday...
some reporter I am...gee whiz...can't even spell
Thanks. That's more info than provided at first.
Don't get us wrong. There's just a whole contingent of FReeprs who will blame illegal immigrants for everything from "Ishtar" to "New Coke."
All we're saying is that, while illegal immigration ~is~ a problem, we can't blame them for orignal sin.
Thanks for the info.
Nor is it often the most important part of the story. Drunk Driving is hardly a crime that would disappear with a better border.
May the family of the child victim find peace.
The child was survived his parents, a 2-year-old younger brother and both sets of grandparents, along with numerous other relatives.
He loved the West Virginia Mountaineers Football team, the Pittsburg steelers and dreamed one day of becoming a professional football player. He loved NASCAR, all-terrain vehicles and motorcycles.
All this was taken away by an asshole drunken driver.
*applause*
I love a FReeper who puts his money where his mouth is. :-D
bump for publicity...
and admonition to late-arrivers to check post 42!
I went to the creep's arraignment today. They finally released him from the hospital at 4pm est and sheriff's deputies were waiting at the hospital door with a warrant.
They rolled him into his arraignment in a wheelchair.
He didn't speak a lick of english, and acted like he didn't exactly know where he was. They had an interpreter in the magistrate court room that wasn't a cop, and certainly didn't look like any federal agent Id ever seen.
At the time of the accident, he had three different forms of identification with three different names. There were two different resident alien identification cards. I assume these are called green cards, but the funny thing is, they weren't green, rather sort of a red color.
The third card was a Michigan drivers license with a third different name, which was a variation of the first two fake names.
ICE has an administrative hold on him, so no from the old home town can come in and post his bond.
If anyone wants to see his picture, and his arrest page, I'' tell you how to find it.
Up until midnight est, his picture can be found at www.wvrja.com
When you get to that page, click on daily incarcerations.
When a new page comes up with the different regional jails, click on southwestern regional jail.
scroll to the bottom of the page, and click on the name Rubio.
His picture should be up soon.
I am not sure why you have to question a Freeper (since 1998) who is an eye witness at the scene of a crime and in addition is a reporter.
I'd take his word - any day - over anything I would read in a 'sourced' New York Times article.
You underestimate the value of Freeper reports.
Believe me, ladyjane - it was nothing personal.
Someone has to be a fact-checker. Otherwise, as I said before, we become little more than a rumor mill.
The facts have been verified by armedanddangerous and that's more than good enough for me or anyone else who happens upon this thread. :-D
The Navarro name is commonly known in drug task force circles in Texas, Oklahoma and Kansas. My company did a lot of huge cocaine trafficing bonds on people by that name. They move their members into a lucrative community and set up business and use the profits to purchase homes and ranch land. It was never a problem to get enough land to make collateral for bail bonds. They were very seldom convicted. Evidence or witnesses disappeared.
First thing tomorrow I'll be at the courthouse to pull the criminal complaint.
I want to know if he's legal, if he's got a criminal complaint, if he has a drivers license and if he even had insurance for the vehicle he was racing in.
He has been brought from Cabell County as of about an hour ago. I checked the jail authority website and he's still in custody down there. The funny thing is, the info lists him as being in there for a misdemeanor arrest.
I'll figure it out. I'm on his ass like a bum on a baloney sandwich.
