The warrant serves as prosecution action in regard to Statutes of Limitations.

But if the state allows the warrants to expire without being served has the statute of limitations lapsed? And how does one serve an expired warrant? Would a new warrant not violate the statute of limitations?

Re: Warrants

I don't know. Somehow I doubt the State is penalized though.

Good question

The warrant system is probably automated and the parameters for expiration are likely set to match the statutory limitation in order to avoid false or unlwaful arrests.

I've stated on here several times that there is reason to be suspicious about that origins of that warrant and I hope that Elmostafa's attorney is examining this for due diligence (of service) and to see if there has been any deviation in normal procedure to get that warrant in the active mode needed in order to serve it.
