DURHAM, N.C. -- A cab driver who has supported an alibi offered by one of the three Duke lacrosse players charged with rape had his own court appearance Tuesday for a larceny charge.
Moezeldin Elmostafa, 37, appeared briefly before a Durham County District Court judge who set a trial date of Aug. 29. Prosecutors also changed the charge against Elmostafa to aiding and abetting misdemeanor larcency.
Elmostafa was arrested in May after he surfaced as a potential alibi witness for Reade Seligmann, one of three players charged with raping a woman at an off-campus party the night of March 13.
The 2003 warrant accused Elmostafa of stealing five purses worth about $250 from a Durham department store. Elmostafa denies the charge, and has said he helped store security locate a woman after he picked her up from the store and drove her home. The woman later pleaded guilty to larceny.
Durham prosecutors said in May the warrant for Elmostafa's arrest was discovered in a routine background check of witnesses in the Duke lacrosse case.
Mostafa has said Seligmann, of Essex Fells, N.J., called for a ride at 12:14 a.m. on March 14, and was picked up five minutes later. The defense has argued those times help establish that Seligmann left the party without having enough time to participate in the 30-minute assault described by the accuser. Seligmann's attorney has also presented cell phone, ATM and dorm keycard records to help establish that timeline.

If Gottlieb was promoted to sergeant in May of '05, he probably was still on probation in that position at the time this case arose. Most LE promotions have at least a one-year probation period. Was Gottlieb pressured to go along with Nifong because of an unspoken threat to bounce him if he didn't play ball?
It's pretty far out there, that is for sure. I saw a few bad ones over the years, but nothing remotely close to this. This is pure, unadulterated corruption.
Don't let three pages of hand-written notes that serve as the basis for 33 typed pages turned over late in the discovery game throw you. The defense will eat this alive.
I should add......don't forget that Gottlieb is seriously damaged goods.
Out of curiosity, does anybody know what the time line was of this July 17 turnover of the notes in relation to the Blinco's incident?

The defense must be salivating over the bogus notes.
That's what I think, and i think that's why the driver and the boyfriend told about sex she had had, and also why she told UNC medical that she's had a lot to drink the night before, not to explain away lack of pain.
Blinco's incident was 3 days after the Defense got the Notes.

I think that the purpose of the notes is to preserve the search warrants. Remember, it was the medical claims that got their foot in the door. If that goes, then they don't even have the fingernails.
It may well not be a Durham jury.
You could definitely be right - Gottlieb feeling proud and cocky about his masterpiece manuscript.
Notes are typed on a computer - can the defense ask for Gottlieb's computer to see how many versions were worked? how many edits?

THe question becomes what notes did he take. Have they been turned over to the defense? Can the timing of the notes be validated? The defense has work to do, but if the typed report is fiction then it should be easy to tear it apart.
He had to pay for the license plate sticker tag, but he may not have had the vehicle inspected, thus that tag may have been expired. Many people delay their inspection tag and float it as long as they can get away with it.
