DURHAM, N.C. -- A cab driver who has supported an alibi offered by one of the three Duke lacrosse players charged with rape had his own court appearance Tuesday for a larceny charge.
Moezeldin Elmostafa, 37, appeared briefly before a Durham County District Court judge who set a trial date of Aug. 29. Prosecutors also changed the charge against Elmostafa to aiding and abetting misdemeanor larcency.
Elmostafa was arrested in May after he surfaced as a potential alibi witness for Reade Seligmann, one of three players charged with raping a woman at an off-campus party the night of March 13.
The 2003 warrant accused Elmostafa of stealing five purses worth about $250 from a Durham department store. Elmostafa denies the charge, and has said he helped store security locate a woman after he picked her up from the store and drove her home. The woman later pleaded guilty to larceny.
Durham prosecutors said in May the warrant for Elmostafa's arrest was discovered in a routine background check of witnesses in the Duke lacrosse case.
Mostafa has said Seligmann, of Essex Fells, N.J., called for a ride at 12:14 a.m. on March 14, and was picked up five minutes later. The defense has argued those times help establish that Seligmann left the party without having enough time to participate in the 30-minute assault described by the accuser. Seligmann's attorney has also presented cell phone, ATM and dorm keycard records to help establish that timeline.

Makes sense.
So a solicitation charge would be for a pimp and a john?
I suppose so, I wouldn't really know for certain. ;-)
I found this rather disturbing:
http://www.raywarrenlaw.com/Amendment-QA.pdf#search=%22NC%20statutes%20prostitution%2C%20solicitation%22
It is. That world is distrurbing.
I have heard dso many people make reference to the team hiring a stripper and all with a big gasp and a hoklier than thow condemnation for being degrading.
I have yet to hear one of those holier than thou, santimonious morons mention who is also degrading the woman-the pimp. The pimp who sells his wares on the street and could care less who he sells her services to as long as he gets his money.
Isn't it amazing that the arrest statistics are so low for Durham County, considering they have a far larger sex industry?
Former Atlanta Mayor Andy Young blames Jews, Koreans and Arabs for "ripping off" Blacks.
In an interview, Young was asked whether he was concerned that Wal-Mart causes smaller, mom-and-pop stores to close.
``Well, I think they should; they ran the ´mom and pop´ stores out of my neighborhood,´´ the paper quoted Young as saying. ``But you see, those are the people who have been overcharging us, selling us stale bread and bad meat and wilted vegetables. And they sold out and moved to Florida.
I think they´ve ripped off our communities enough. First it was Jews, then it was Koreans and now it´s Arabs; very few black people own these stores.´
I have always liked Andy Young, Hated his politics, but I have always liked and respected him. He is a good man.
Going back to the early 70's when I about to graduate from high school, he ran a PSA about staying in school. In effect he said if you are thinking about dropping out, come see me first. Give me a chance to talk to you, give me a chance to change your mind.
I know his target audience were the kids in South Atlanta. But I had no doubt, if I, a white girl from Chamblee, went to his office, he would speak with me the same as anyone else.
With the passing years he went beyond the local political scene. But he remained a presence in South Atlanta.
I understand what he was trying to say. I am not going to get excited over this. He still has my respect. I really don't think he is an anti-semite. If I am wrong, I will be devastated.
After reading this article, I am starting to wonder about a few things.
Cash Michaels wrote on the wabc board:
"..... she had to separate from her children for a while, has recieved death threats at her parents' home, hadn't seen her father for months until they accidently ran into each other two Friday's ago at his sister's home, ....."
and from this article:
"...She has cut off contact with her family, and neither police nor the district attorney would say this week whether the woman is still cooperating with them.
The woman was recently observed leaving the Durham Police Department's headquarters with her two children. ..
...
The 62-year-old retired truck driver says he hasn't seen his daughter since June, when he happened to spot her sitting in a friend's car at a traffic light on Fayetteville Street.
"She said she was doing fine," he said. "I asked where [her] kids were, and she said they were out of town. ... Then the light changed."
The accuser's father and mother said they are desperate to see their grandchildren, ages 7 and 6.
Perhaps she just doesn't want to face her mom and dad since everyone has found out what she really does for a living...
Nah--that just doesn't seem to fit. Doesn't "feel" right. But I could be wrong.
Are you basing this on giving the AV credit for knowing what she is doing? ;-)
Anger doen't take much knowledge.
I don't know, it could be a perceived wrong...but there are some serious issues if she is keeping her kids away from the grandparents (or Social Services).
Oh, I agree that thee are some serious issues. My biggest concern is where these kids are while the "mom" is working...
That is a very good point. Also for years she has been lying to her parents when they didn't a clue in the world about what she was doing. So much has come out about in the papers casting doubt on what she said that she might fear that she can't pull off lying to her parents when the do have a clue.
Have you noticed that each week for the past two or three weeks, the Wilmington Journal goes longer and longer between updates?
That I have....
maybe a bit of regrouping.
Regrouping or "circling the wagons"? ;-)
The article did say she was seen leaving the station with the kids in tow. That is the one thing that might eliminate Social Services.
Who knows, maybe she does a a real friend or two from "the good side."
But that thing about the parents not knowing anythiing (if true) about the kids is telling.
Of course, the mother said Nifong was protecting her sometimes out of state, so who knows?
Arrests made in 2 'cold cases'
Durham police use autopsy data
Matt Dees, Staff Writer, N&O Published: Aug 19, 2006 12:30 AM
DURHAM - Police made arrests in two old cases Friday, using autopsy results in both to bring murder charges.
Rodney Thomas Melvin, 30, of 2129 Chapel Hill Road, was arrested and charged with murder after a woman shot in 1998 died of her injuries this summer.
Justin Jaquane Hope, 26, was arrested and charged with murder in the death of a 22-month-old boy last summer.
Melvin is accused of shooting Christina Maria Cozart in the head, chest and arm inside a Durham apartment nearly eight years ago. She died in June at age 30.
An autopsy revealed that the fatal seizure she suffered was the result of the gunshot wound, and the cause of death was listed as a homicide by the state medical examiner's office.
Durham police spokeswoman Kammie Michael said investigators consulted with Assistant District Attorney David Saacks to determine whether murder charges were appropriate.
In late 1999, Melvin was convicted of assault with a deadly weapon in the incident and served a prison sentence until 2004.
Michael said it's not clear why Melvin shot Cozart while she sat at Melvin's sister's apartment.
"It was not a domestic incident," Michael said.
Saacks could not be reached for comment.
Hope was baby-sitting 22-month-old Deshaun Williamson on Aug. 18, 2005,when authorities responded to a call that the child wasn't breathing.
He was taken to Duke Hospital, where he was pronounced dead.
No trauma was detected on the child during an initial examination, but an autopsy revealed a fractured skull and showed the cause of death to be blunt force trauma to the head. Hope was arrested one year after the child died.
Michael said authorities weren't sure how the injury to Deshaun occurred. Psychologists who specialize in dealing with children who've suffered trauma spoke with two of the child's siblings who were present when their brother died. Those sessions led to the arrest, Michael said.
Hope also is one of three men charged with murder in the 1997 shooting death of Michael Stevon Hunter. He is awaiting trial on that charge.
He was taken into custody by Durham police at the Lanesboro Correctional Institute in Polkton, where he is serving a sentence for possession of a firearm by a felon.
The arrest of Hope marks the sixth "cold case" Durham police think they've solved this year.*

* There have been a number of recently solved cold cases involving DNA also. Local wags speculate the multiple specimens found on the FA /AV /CGM have set off alarm bells in the computers of the SBI laboratories.
I bet she does lots of friends...
