Trial date set for Duke lacrosse witness (DukeLax Cabbie to be Nifonged)

DURHAM, N.C. -- A cab driver who has supported an alibi offered by one of the three Duke lacrosse players charged with rape had his own court appearance Tuesday for a larceny charge.

Moezeldin Elmostafa, 37, appeared briefly before a Durham County District Court judge who set a trial date of Aug. 29. Prosecutors also changed the charge against Elmostafa to aiding and abetting misdemeanor larcency.

Elmostafa was arrested in May after he surfaced as a potential alibi witness for Reade Seligmann, one of three players charged with raping a woman at an off-campus party the night of March 13.

The 2003 warrant accused Elmostafa of stealing five purses worth about $250 from a Durham department store. Elmostafa denies the charge, and has said he helped store security locate a woman after he picked her up from the store and drove her home. The woman later pleaded guilty to larceny.

Durham prosecutors said in May the warrant for Elmostafa's arrest was discovered in a routine background check of witnesses in the Duke lacrosse case.

Mostafa has said Seligmann, of Essex Fells, N.J., called for a ride at 12:14 a.m. on March 14, and was picked up five minutes later. The defense has argued those times help establish that Seligmann left the party without having enough time to participate in the 30-minute assault described by the accuser. Seligmann's attorney has also presented cell phone, ATM and dorm keycard records to help establish that timeline.

I don't think this was caught yet:

If you remember a couple weeks back, the
News & Observer ran the races of the AV and the
suspect in the Blincos beating. They also
printed that racial epiteths were reportedly used by
Police IN THEIR ON-LINE VERSION.

The Paper version was cleansed of all such damaging
information.

Well, Lookie what happened today. The following was
ommitted from the Print version!

"According to notes taken by Investigator Benjamin Himan, Wilson said that NIFONG WANTED TO BE TOLD when the taxi driver was arrested.

The prosecutor's office or police collected evidence on Elmostafa that included his insurance and driving history, several years' worth of drug tests -- all of which were negative -- and a criminal record check......"

"The case against Elmostafa is at least the second time in which a witness involved in the lacrosse case received personal attention from Nifong.

The second woman hired to dance at the party was arrested on a probation violation immediately after she gave a statement to investigators. Nifong personally signed paperwork that changed KIM ROBERTS' bail status, which FREED HER from having to pay a $1,875 balance to her bail bondsman.

Nifong said the change was routine and denied it had anything to do with the lacrosse
case."


So, NIFONG's Involvement was excised and the
disparate treatment of Kim Roberts was erased too!

The two most DAMAGING parts of the article!!!

PBR, random drug screening is required for drivers for legitimate businesses. Doubt that Precious' drivers had to have them though.

So is he going to let her out of the other jail time she is supposed to do? Her last release date is 4/8/07.

She is serving 3 consecutive sentences.

If Nifong lets her walk on all 3 incarcerations, we all need to raise hell! Her rap sheet is pretty extensive, and he would have to know how it would look....oh wait... He doesn't care! What a POS!!!!

I had to back away from this for a while, but now I am even madder than I was when I was following every day!

I spent this past July working at RTP. I stayed at the Hilton off of Page Rd.

I spent some time in Durham on the weekends. I went to a Bulls game a few Sundays ago. A beautiful stadium, I must say. I walked the campus of Duke; I even walked the floor of hallowed Cameron Indoor. Yet the oddest thing was how there we NO ONE out on the one Friday night I was in Durham. A group of us ate dinner at Tyler's Taproom. I ate there four times during my month. Never a wait, and after dinner on the one Friday, we walked the little mall outside and headed for Raleigh around 10pm. Downtown Durham also has almost no traffic. I found that odd also.

It is always this way? Raleigh was pretty busy on the weekends.

That bad, eh? One of my group played high school ball with a former Duke hoops player from St. Louis. We actually ran into the former ACC player of the year at a Gold's Gym. He was in town for the Coach K Fantasy Camp.

That might have helped me out? I never felt unsafe, I must say. It was just QUIET.

Actually, the only place I felt unsafe was Raleigh, where I had a knife pulled on my because I received my beer faster than some local.

I guess it may have been quiet in Durham because everyone was at the sex clubs. What kind of place were you hanging around where you could get a knife pulled on you? Blinco's? LOL!

If she's been convicted, which I understand she has been, she won't be terribly credible in the first place, particularly if it turns out that she's been promised something in exchange for her testimony. According to our member named Mike Nifong, she was arrested on July 7, but he didn't say what for.

As for the elements of aiding and abetting, it depends on how the statute is written in NC. It usually requires encouragement of another (abetting) to commit a crime and certainly knowledge of a crime before it is committed and that some sort of assistance is provided that facilitates the commission of the crime, not just silence after the fact. Proof of criminal intent before the crime has been committed is generally required. Nevertheless, it's generally easier to prove than actual commission of the crime.

From these cases Nifong seems to be in favor of deals for females.

It wasn't Blinco's. It was a packed bar with about 400 people in it. Weirdest thing I've experienced in the past 10 years or so. Luckily getting older (30ish) has taught me that getting out of there immediately was the best solution.

I did drive by 610 N. Buchanan. The house was larger than I anticipated. It is vacant. Also, the neighbor witness' house is vacant as well. The houses are within 15' of each other with the famous stairwell closer. I imagine the neighbor did hear everything.
