MARTINEZ -- Another attorney has declined to represent convicted murderer Susan Polk before she is sentenced for killing her husband.
Vallejo attorney Dan Russo told Contra Costa County Superior Court Judge Laurel Brady today that Polk was "not completely comfortable with me."
"I apologize," Russo said. "I'm not going to be able to accept the case."
Russo said, however, that Point Richmond attorney Linda Fullerton had expressed an interest in representing Polk.
Fullerton is a member of the county bar association's conflict panel, which assigns attorneys for defendants. Last week, Brady said 19 attorneys who were part of the panel and had experience with homicide cases were all unavailable.
The judge scheduled the next hearing for Monday.
. . . Polk's case manager, Valerie Harris, said Polk needed an attorney who would be able to spend full-time on various issues, including considering asking for a new trial. Although Russo was "fabulous," any attorney for Polk shouldn't be saddled with other cases and must be able to "hit the ground running," Harris said.
"I've got a little laundry list of items to give to the next attorney," Harris said.
Prosecutor Paul Sequeira accused Polk of stalling. He said he wants to ask the judge Monday -- regardless if Fullerton accepts the case -- to set a sentencing date because it's almost two months since she's been convicted.

I knew that this story was never going to go away.
In other words, since I've never known of a good attorney that doesn't have other cases, only losers need apply. However, with a client like Mrs. Polk, it would probably be best to be unsuccessful because she'll probably end up suing you and making your life a living hell for the rest of eternity.
