Thursday, August 10, 2006 Dear Friends and Neighbors,
The Committee to Recall Nifong - Vote Cheek was formed on August 9, 2006 as a political action committee to campaign for Lewis Cheek in the upcoming election for District Attorney. While Mr. Cheek has declined to campaign for this office, and has stated that he will not accept the position if elected, we believe that this election, and the referendum on Mr. Nifong that it has become, is not about politics but rather about Durham and what Durham stands for.
The Committee to Recall Nifong - Vote Cheek (RNVC) is not comprised of politicians in any way, shape or form. The people who have organized and will direct this campaign over the next few months have no personal political ambitions and no affiliation with any of the parties involved in the drama that has shed such a bad light on the community of Durham. RNVC is not a movement born of political ambition, nor is it only about the Duke drama. RNVC does not campaign on its own behalf, nor on behalf of any person with ambitions to be the District Attorney of Durham County. RNVC will campaign on behalf of the entire Durham community, save one.
Our movement was born in Durham homes by Durham citizens and for the Durham community. This Durham community, to which the participants in RNVC proudly belong, has become the target of nationwide ridicule and scorn. Durham County has been manipulated, deceived and divided by inflammatory, ambition-serving words uttered by the man entrusted to protect it. RNVC believes that the role of the District Attorney should be that of a protector, and not that of a divider. RNVC believes that the community deserves a District Attorney that inspires trust and not fear. It is the fear of Mr. Nifong and distrust of his words, motives and competency for office that has inspired this movement.
If one of our daughters were the victim of a violent crime, we do not want the person pursuing justice on her behalf to be one who compromises the pursuit of justice either by serving his own self interests, or by his own failure and unwillingness to follow procedure. If one of our sons were to be accused falsely, we do not want a District Attorney who would see those false accusations as an opportunity to defeat a bitter rival in a primary election. We believe that our justice system must not be compromised by misdeed or willful mistakes.
We believe that our district attorney must be one who allows a thorough investigation to precede his public proclamation of guilt or innocence. We believe that indictments should be brought based on evidence at hand, and not evidence hoped for. We believe our District Attorney must value procedure, due process, the rulings of our states Supreme Court and the constitution this nation was built on. We believe that our District Attorney must not be allowed to interject himself into a Police investigation in such away that he instructs them to disregard the recommendations of the North Carolina Actual Innocence Commission, as approved by the NC Supreme Court. We believe that our District Attorney must not be a man who manipulates our law enforcement investigators into violating the Departments own written policies simply to secure indictment before election.
We have heard Mr. Nifong ask Durham to consider the entirety of his career in the District Attorneys office. We fail to see the relevancy of his performance in lesser roles within the office as an indicator of how he will perform when holding the power of the Office of District Attorney. We ask all of Durham to instead inspect his actions, his words and his motives while he has briefly served as District Attorney. We believe it is far more relevant to this referendum to inspect his conduct, questionable ethics and lack of performance in the short time that he has held the extensive powers and responsibilities of District Attorney.
Of all that we believe in, and of all that we ask of our community, with regard to this referendum on Mr. Nifong, what we hold most dearly is the notion that we all must speak. We believe this election is what the Durham that we love is about and, as such, requires a true and full measure of consideration by each of its citizens. We ask that Durham show, not only to Mr. Nifong, but also to Governor Easley and to the nation that watches, that Durham cares, that Durham has pride and, most importantly, that Durham has a voice.
We ask that you add your voice to ours.
How much of a donation to the NC GOP would it take for them to have Monk wrapped in duct tape until November 8?

You're correct on both points. I was impressed that Michaels knew when the Police actually received the Medical report - and he knew that the investigators' stories weren't making sense.
I agree with your earlier point that the title and the beginning of the article seems disjointed.
Chalmers' picture is included as if to say - he's black - we can trust him.
Does Michaels expect Chalmers to come out and say - Yes, our officers have been known to perjue themselves and fabricate evidence. This is nothing new, I wouldn't believe anything they have to say - ?
One thing is certain, anyone in the Media that cares to take 30 minutes to read the motions and a story or two will come away believing these guys are getting railroaded and Justice never was a concern in this case.

Well, all that's true. But I also see the AAs throwing Nifong under the bus as though they, themselves, had no hand in the ugliness that transpired during that approximately 45-60 days. Remember the pot-bangers? The NCCU forum? Cory Peterson? The NBBP? The candlelight vigils outside the Buchanan house? "Dead man walking"? The drive-by threats? The beating of a white Duke student at a hamburger stand? How about, "It may not be fair, but it makes us even"? The black reverend somebody-or-other and the church marches to the Buchanan house? The posters?
No, black Durhamites may want to cry victim once again by blaming Nifong for the wholoe mess, but they need to face facts. If they weren't so blinded with racial hatred in the first place, they would have withheld judgment - and their ignorant demands and threats - and let the process take its course. But no. As usual, they had to get loud.
It's a sad comment that a white candidate has to create a racial issue in order to get votes from Durham blacks because they vote in a lockstep block. There isn't one independent, original thinker among them. Think about it. They've banded together in order to make themselves a political force to be reckoned with. Okay. But all of their issues are race-based, and they all vote the same way - as they're told, basically. Through their own doing, they were ripe for a Nifong to come along and pander to their blind racial hatred, so pardon me if I don't fall all over myself because some dude named Cash Michaels finally figures out they've been had (by yet another Democrat). I hope they catch onto the final straw, and that is that it's obvious from the evidence that Nifong could not have believed Mangum's wild, shifting stories even at the outset of the case. Their first clue to his pandering for their vote with no ammunition behind the case should have been when Nifong pressed on even when the DNA said otherwise. Idiots.
Now look at the damage that the perfect storm of the black Durhamites racial hatred combined with the ambition of a useless nobody hack like Nifong have wrought for these boys. Some people are just too stupid and too mean to be allowed to vote or to run for office.
Cash Michaels may be smart enough to get out in front of the coming tide of blacks against Nifong, but he wasn't smart enough to look past his own ugly prejudice and see this case for what it was when all the earmarks were there three months ago. So let's not kid ourselves that he's changed his position from a position of moral authority. He's simply capitalizing on the inevitable.
This is going to be interesting.
Thanks, abb.
LOL! Monks is a dork, isn't he? Jeez, if anybody ever needed to shut up and go away, it's Monks. I HOPE somebody convinces him to bow out. Maybe Bob Bennett can do it.
You have a point. Cash has written some inflammatory articles on this case but my hope is that the obvious lack of evidence has had an effect on him. I hope he keeps the pressure on Nifong to explain himself. Someone has to do it and alot of the local media there are just clueless.
Some people (both black and white) seemed to want to believe these allegations for their own reasons. Prejudice, envy and all kind of resentments bubbled to the surface. Nifong played into that but he was only able to do it because they let him. You're right about that. The pot-bangers were so eager to pronounce guilt. Or maybe they never even cared about guilt or innocence and they just wanted to take all the players down. Scary. I sometimes wonder what they think now.
Yeah, I am really sorry that Cash was so dense that it took him 5 months to figure this thing out. It took me all of about 30 seconds to see that none of the FA's stories made any sense. Then all the lack of evidence just confirmed what a little common sense told me.
Cash it after money out of this thing. Wait and see. This is setting up Durham County and Duke for a lawsuit by the False Accuser for everything she has been through. You know all the things he has said about lynch mobs, cutting her hair, being away from her children for a while, not seeing her father and running all the way to Greensboro with news photographers chasing her. Yep, here come the civil suits. She might even add in the whole lacrosse team for having the party. It is becoming pretty clear.
She can't go after the Durham's county. She could be arrested for making false allegations faster than you can say cheese.
Maybe. It depends on how effective Cash&Co.'s politcal/media immunization program works out...
If she sues Durham county they can have her arrested for making false charges. And I don't see any case against Duke. Her story is obviously crap and she brought the whole thing on herself. She could have stopped this at any time. If just telling the truth was out of the question then she could have just said she couldn't ID anyone.
Maybe she could sue for falling on the stairs as she was leaving since Duke owned the house. But if you walk around with one 6 inch platform shoe on I guarantee there's a fall in your future. Sounds like comparative/contributory negligence to me.
When it comes to lawsuits, I think she has a better chance of being a defendant then a plaintiff.
Wait and see. False charges could result in only a misdemeanor. Believe me filing a lawsuit has been the plan all along. This is just setting it up. They are going try to make it seem that she was used by a corrupt DA and Duke did nothing to stop it. Anyone can file a lawsuit. Whether she could win in court is another thing. But, don't bet against Durham County rolling over and paying her off. Also, Durham PD is probably to be included in the suit.
I don't disagree she should be a defendant in a lawsuit, but Cash Michaels has written enough in forums that you can see where this is headed.
So Plan A was for Crystial & Co. to extort money from rich Dukies in return for dropping the charges. Didn't work. Now to Plan B...
"They are going try to make it seem that she was used by a corrupt DA and Duke did nothing to stop it."
And they'd be right.
And furthermore, if the AV wants to write a book about how she was pressured by a corrupt DA into making and then maintaining the charges, she will emerge in the public eye as another victim of this tragedy; her book will sell, there is the prospect of a TV movie, etc.
However, if she stays with Nifong, she will in the end only apppear as an accomplice of Nifong, and there won't be any
book or movie nor anything else.
Duke did nothing to stop it? Who are you kidding? She came up with false allegations, but now is going to sue people because they didn't stop her from making false allegations?
Well, if Nifong was too dumb to cover his butt early on, in the eventuality that the FA would go rabbit, he is REALLY dumb...
