Thursday, August 10, 2006 Dear Friends and Neighbors,

The Committee to Recall Nifong - Vote Cheek was formed on August 9, 2006 as a political action committee to campaign for Lewis Cheek in the upcoming election for District Attorney. While Mr. Cheek has declined to campaign for this office, and has stated that he will not accept the position if elected, we believe that this election, and the referendum on Mr. Nifong that it has become, is not about politics but rather about Durham and what Durham stands for.

The Committee to Recall Nifong - Vote Cheek (RNVC) is not comprised of politicians in any way, shape or form. The people who have organized and will direct this campaign over the next few months have no personal political ambitions and no affiliation with any of the parties involved in the drama that has shed such a bad light on the community of Durham. RNVC is not a movement born of political ambition, nor is it only about the Duke drama. RNVC does not campaign on its own behalf, nor on behalf of any person with ambitions to be the District Attorney of Durham County. RNVC will campaign on behalf of the entire Durham community, save one.

Our movement was born in Durham homes by Durham citizens and for the Durham community. This Durham community, to which the participants in RNVC proudly belong, has become the target of nationwide ridicule and scorn. Durham County has been manipulated, deceived and divided by inflammatory, ambition-serving words uttered by the man entrusted to protect it. RNVC believes that the role of the District Attorney should be that of a protector, and not that of a divider. RNVC believes that the community deserves a District Attorney that inspires trust and not fear. It is the fear of Mr. Nifong and distrust of his words, motives and competency for office that has inspired this movement.

If one of our daughters were the victim of a violent crime, we do not want the person pursuing justice on her behalf to be one who compromises the pursuit of justice either by serving his own self interests, or by his own failure and unwillingness to follow procedure. If one of our sons were to be accused falsely, we do not want a District Attorney who would see those false accusations as an opportunity to defeat a bitter rival in a primary election. We believe that our justice system must not be compromised by misdeed or willful mistakes.

We believe that our district attorney must be one who allows a thorough investigation to precede his public proclamation of guilt or innocence. We believe that indictments should be brought based on evidence at hand, and not evidence hoped for. We believe our District Attorney must value procedure, due process, the rulings of our state’s Supreme Court and the constitution this nation was built on. We believe that our District Attorney must not be allowed to interject himself into a Police investigation in such away that he instructs them to disregard the recommendations of the North Carolina Actual Innocence Commission, as approved by the NC Supreme Court. We believe that our District Attorney must not be a man who manipulates our law enforcement investigators into violating the Department’s own written policies simply to secure indictment before election.

We have heard Mr. Nifong ask Durham to consider the entirety of his career in the District Attorney’s office. We fail to see the relevancy of his performance in lesser roles within the office as an indicator of how he will perform when holding the power of the Office of District Attorney. We ask all of Durham to instead inspect his actions, his words and his motives while he has briefly served as District Attorney. We believe it is far more relevant to this referendum to inspect his conduct, questionable ethics and lack of performance in the short time that he has held the extensive powers and responsibilities of District Attorney.

Of all that we believe in, and of all that we ask of our community, with regard to this referendum on Mr. Nifong, what we hold most dearly is the notion that we all must speak. We believe this election is what the Durham that we love is about and, as such, requires a true and full measure of consideration by each of its citizens. We ask that Durham show, not only to Mr. Nifong, but also to Governor Easley and to the nation that watches, that Durham cares, that Durham has pride and, most importantly, that Durham has a voice.

We ask that you add your voice to ours.

I am so impressed with the academics at Duke. My student has not had one, NOT ONE TA teach a class. Sure wasn't the case at LSJU. Don't know about UF, just sayin'. From what I have seen, everyone has to bust their buns, academically speaking, to make a go of it at Duke. Certainly, I have no experience with UF - but I must chime in to say Duke's academic standard is impressive.

Yes, this is me. I've always had a membership on this board, and have been asked many times in the past to log on and weigh in, but I just didn't have the time.

I still don't, but for now, here i am.

So that you don't go off believing this stuff about me "jumping ship," let me make you aware of the ship I was always on -

The Black community was told that a brutal crime was committed against someone in our community. The police and District Attorney left no doubt that a crime had been committed. In their public pronouncements and official applications to the court, they cited "evidence" (medical report, etc.) to back up their claims.

Now, today, exactly five months to the day of the alleged crime, the Black Press is asking, "WHERE IS THE EVIDENCE?"

Chief Chalmers still insists that his investigators have done their jobs, and we will see the fruits of that at trial. But based on what the record shows thus far, given a sober, unbiased analysis of press accounts and what is now in the public domain regarding the 1800 pages of discovery evidence (we were not offered, nor did we ever have access to those documents), it is clear that the African-American community, and certainly everyone who supported the alleged victim early on, based on the assurances of law enforcement and D.A. Nifong, is deserving of a full explanation of these discrepancies, a few of which are outlined in my story (which was actually finished and distributed nationally a week ago BEFORE I got on the abc11tv forum).

Though I did share Chief Chalmers remarks on the TVD site, since he made them in answer to a question I submitted for the TV show i appear on, i could not talk about my story until the Journal posted it, and I had no idea when that would happen given that folks were out on vacation, plus I'm learning now, some computer problems they ran into.

So why the so-called "shift?" Because it isn't a shift. It is a DEMAND of the criminal justice process to be immediately accountable as to what is going on, and where is the evidence of a crime you insist you have.

As a reporter on this case, that has been my charge since the beginning - to monitor the process, and make sure that it is working. And if it isn't, ask tough questions why.

(My other charge has been to expose those who sought to destroy the alleged victim long before a trial, or conclusive judge's ruling, was had.)

That's what my story does, in the context of Chief Chalmers' most recent answer.

The Black community is not blind, or blinded. We want the truth too. But instead of distilling this case in bits and pieces, which is what the media in general have done (to their detriment), we look at it in context and much more deliberately, so that when we do publish a story like this one, EVERYONE knows we're about business.

Let me put this even more bluntly - if the state can't prove its case, which is what it promised (overpromised really), then it needs to be dismissed, because no one likes to be lied to.

Especially a community to whom fairness and justice in the criminal justice system has been few and far between.

Right now, I'm not planning to write anything this week (actually i might go after my friend Juan Williams and his new book), but next week, everybody's scheduled to be back in court.

As I write this message, the producers for Imhotep Gary Byrd's radio program on WLIB-AM in New York just booked me for an interview at 12:15 tonight - thanks to the story being published in the Amsterdam News there, so those who can listen in, are invited to.

So nothing's changed here. We just want answers.

The author concludes the article with a statement that because the case is so poor, there may never be a trial and the "African-American community" will want to know why. Well, DUH! The statement itself explains WHY - the case is poor. It also assumes that blacks are so full of racial hatred of whites that, even in the face of overwhelming evidence that Mangum is a liar, Nodong is pandering to the black vote, and that Mangum and Nodong are both whores in their own ways, that the "African-American community" (gawd how I hate that stupid term) still wants these boys convicted evidences irrational racial hatred of whites by blacks. The statement basically amounts to a complete admission of this.

It's kind of funny that a no-account white dude like Nodong led them down a path where they now look like complete racist fools for continuing to back Mangum just because she's black and because Nodong managed to rope three innocent white guys into the defendant's chair in order to get their vote.

They got what they paid for.

Nifong will never dismiss this case. He is now DA Queeg and only a forum beyond his control - another court or the ballot box - can shut him down. He is a demented person elected largely by black Durhamites out of their racial hatred toward whites.

One can only hope that enough blacks speak publicly against what is happening such that it paves the way for the cowardly NC judicial establishment to dump the case without fear of backlash from blacks either in the form of riots or at the ballot box when s/he/they comes up for re-election.

Sure, and Nodong deserves it, but they're also trying to absolve the appearance of their racial hatred which bared its ugly teeth during the first couple months of this case and continued even as emerging evidence ruptured the underpinnings of their "Get whitey" bandwagon.

I will not forget, "They may not be guilty and it may not be fair, but it'll be even."

Who is the judge going to be?

Is it Stephens, or Titus,
or Bushfan?

This is just another outrage, and I hope Elmostafa sues the city for everything they're worth.

Indeed, although I think Aesop's famous line was from a parable more in line with 'what goes around comes around', if I recall correctly (and I may not, lol!).

I think he's read it but if asked, he would of course deny it. I think that, like Queeg, Nodong follows every bit of minutiae on this case and takes great offense (and revenge, when possible) against anybody he views as opposing his authority and position.
