Nifong: Every Member Of Duke Lacrosse Team A Potential Witness

Every member of Duke University's men's lacrosse team is a potential witness in the case against three players charged with rape, Durham's lead prosecutor said Monday while arguing for access to their student ID card records. "We want to be able to confirm what they tell us about where they went afterward," District Attorney Mike Nifong said of the uncharged players.

Titus also formally reaffirmed the state's rules governing trial publicity and disclosure of information to the public and the media. The order does not prevent attorneys in the case from talking publicly, but does prohibit statements that have a "substantial likelihood of materially prejudicing" the case. "The rules of professional responsibility require us to be very careful of what we say," said Wade Smith, one of Finnerty's attorneys. "We'll do that. We've been doing that. And we'll continue to do that."

So let's make sure we don't get cooled out.

Frankly, I think one of the reasons Nifong is so irritable is that public attention hasn't gone away. He looks like a complete idiot for continuing to pursue this case.

abb, you are correct. Joe Cheshire is very well known in NC. He is not your ordinary, run of the mill defense attorney. There has been a Joe Cheshire practicing law in NC for many decades. That is why I laughed out loud when I read Nifong's statement about the defense attorneys not wanting to face him in court. Joe Cheshire V might be afraid of something or someone, but it sure isn't Durham DA Mike Nifong.

Don't know who the targets should be, but I do think that we and anyone else who values justice should do everything possible to keep this case in the public eye.

If there has ever been a case that doesn't need a gag order, it's this one. We are witnessing how twisted the criminal justice system has become. In 1987, Tom Wolfe wrote about the Great White Defendant. It was fiction back then. Folks, it's real now.

BTW, there were a couple of lengthy posts on the CTV board today that provided insight on the black community's feelings about this case. Wow! Read them if you get a chance.

Truthful.......... Nifong is worried about these kids being truthful? One of the lawyers today mentioned his client cooperated with the police and volunteered to take a lie detector test. I would have died laughing if he asked Nifong if Magnum has volunteered to take a lie detector.

It is crystal clear (pardon the pun) to me that Nifong is fishing for any evidence he can dig up now, because he has none that can win the case.

But what exactly can he dig up at this point? Reid and Collin seem to have good alibis. I don't know how any information on these 5 other kids ruin the 3 charged case. Further more if he is looking to indite some new people on the rape charge it will end up hurting his case on any new person and the 3 already charged. I think this is nothing more than Nifong looking to intimidate future witnesses.

The lacrosse families will never be cooled, that's for sure.

Finnerty won't be for sure, since this bogus charge has cost him a past plea deal. Reid has such a good alibi he might go after some people too. Not sure about Evans but if the other two take this to civil court I think he will go along with them too.

Yes, they were following the Jesse Jackson talking points. I cringe when I see that woman, Georgia Goslee. She cannot refer to anything involving the Duke case as "alleged", she always refers to the "brutal rape".

I just listened to a replay of the hearings. Here is what I think was the most offensive thing Nifong said during the second hearing on the motion to quash the release of information about the unindicted players.

Nifong: If the defendants prevail in this particular motion, then the State will certainly have to come to the court and provide a request to the Court for the information with respect to these home addresses and everything so we can subpoena these people as witnesses. I think that we’re entitled to that.

These people were witnesses whether they want to be here or not. And they don’t have you know anything other than the Fifth Amendment right at this point not to incriminate themselves because they’re not charged with any offense.

And I know that it looked sometimes over the course of the last few months as if some of these attorneys were almost disappointed that their clients didn’t get indicted so they could be part of this spectacle here in Durham. But that’s the situation.

We only indict based on our evidence. We can’t indict everybody. But we are entitled to present a case to the citizens of Durham whereby they can determine what occurred in this case.

Absolutely incredible that he got away with this bullsh*t.

I kept getting the "page can't be displayed" thing for a while. So it must have been.

Nifong is an idiot who just keeps embarrassing the state of NC everytime he opens his smirking mouth. He thinks he's intimidating while the rest of the country is laughing at him.

Did you read Joe Cheshire's bio? This is not the first time he's dealt with corruption:

In 1977, at the age of 29, he was appointed special prosecutor for Wake County and oversaw the prosecution of the long time Sheriff of the county and numerous of his deputies in an extensive corruption scandal. In announcing the appointment, the Chief resident judge of Wake County stated as one of his reasons for the appointment “You can go back through five generations of lawyers in the Cheshire family and (never hear) of a Cheshire being accused of dishonesty or lying down. It’s very unusual”.

Am watching it slowly. Play, pause, rewind, play, pause, rewind LOL!

At about 4:48 (Osborne still up) the camera closes in on Nifong. At first I thougth it was that stupid smirk, but as the camera moved closer it seemed it was a frozen smile.
Then it seems as if he has some sort of facial tic betraying his emotion which is anger(?).

I will keep watching to see if it is a pattern, just wanted to throw it out there to see if anyone else noticced.
