Abrams and Filan said this morning that it doesn't look good for the prosecution. They hightlighted how the medical report directly contradicts the AV offical statement to Police.
Her statement doesn't match Kim Roberts' either.
The AV said, in her official statement that Roberts and her were embraced, holding on to each other as the 3 players physically carrying the AV away as Roberts was taken in the opposite direction.
Later, the AV says Roberts stole all her stuff and pushed her out of her car into the street.
MSNBC verifies all the different stories and versions told to diffferent Police/medical personnel."

He's now read every word of the discovery that Nifong handed over to the defense.
This is a terrible case based on what he has read, and Nifong owes the public an explanation for all the contradictory and exculpatory stuff in the discovery. Instead, Nifong refuses to conceed anything and has stonewalled the public and attacked the media for questioning this case.
Former prosecutor Susan Philen is doing Dan's show now that Dan has been moved to the executive offices at MSNBC, and she is interviewing Dan. Susan used to be sympathetic to Nifong, but she agrees with Dan and both of them are dumbfounded at Nifong. They are actually angry and frustrated with him...you can tell.

He's an executive now, but Susan Philen who is replacing him interviewed him for the Nifong segment. Dan has read every word of the discovery Nifong gave to the defens. He is appalled that Nifong is going forward based on what is known about the case so far. If there's something Nifong has that can explain away this awful case he has, Dan says Nifong owes the public an explanation.

In an email response to the magazine, Nifong said, "What has surprised me is the utter lack of any degree of skepticism on the part of the national media with respect to the claims of the defense attorneys, many of which are misleading and some of which are absolutely false." Okay, so which defense claims are misleading and which are false, and what's his backup for HIS claims? Nifong apparently still expects the media and the public to take at face value these sweeping statements he makes, which proves all over again how totally out-of-touch this loser is.
I'm sure he will hide behind 'Oh, I'm not going to try this case in the press.' The trouble is, when it suits him, he has done exactly that by basically leaking disinformation that made his case appear other than it was.
The jerk is obviously trying to hang on by his fingernails and do damage control until the election is out of reach and no opposition can be mounted (end of June?).

But now they are no longer basing their opinion on defense claims - they HAVE YOUR DISCOVERY FILE. That is what they are basing their opinions on.

I think Nifong is going to be surprised that the media aren't going to jump through the hoops for him like they did at first. Except for maybe Nancy Grace, but she'll just shut up about it and move on to other crusades. Nancy won't be alone. Skeletor is still going to be on tv with Hannity. He will continue to defend Nifong and say this case should still go forward.

I'm glad to see Nifong realizes that commenting on a pending case is unethical (he admits such in his email). However, I do not buy for a minute that his orgy of press conferences was merely an appeal to the public for information. First of all, his claim there was no specific target is wrong, as he had about 43 specific targets at that time. Second, speaking to the lynch mob rally at NCCU had no purpose other than political. During an investigation, investigators may discuss the case in the press to a certain degree to solicit information relevant to the case from the general public. A group meeting like that at NCCU is not the general public but an advocacy group. It was a targeted political event. Thirdly, the investigation agency in this case was the Durham Police Department, not the District Attorney's Office. Any appeal for public information should have come from the DPD, not Nifong. The mere fact that the elected DA who was then campaigning for reelection chose to usurp the role of the DPD creates an almost unrebuttable appearance of political motivation. Finally, how does an interview with national news outlets further the task of getting infoprmation from the Durham public? Clearly local media would have been the best outlet for appeals for information.
I believe the 70 interviews were a breach of prosecutorial ethics and Nifong is trying to hide behind the investigator's prerogative to appeal for information. Maybe that means someone on the defense team has called him out on his breach of ethics.
