Prosecutor's Silence on Duke Rape Case Leaves Public With Plenty of Questions

DURHAM, N.C., June 9 — When a woman hired to dance at a Duke University lacrosse team party claimed that members of the team raped her, Michael B. Nifong, the district attorney for Durham County, responded with an aggressive, unflinching and very public investigation.

"There's no doubt in my mind that she was raped and assaulted at this location," Mr. Nifong said on national television after the case surfaced in March. Mr. Nifong called other lacrosse players "hooligans" who had aided, abetted or covered up for the rapists. Local police officers seemed equally certain that they had a horrific crime to solve.

But in the intervening months, the case has come to appear far less robust. Three players have been indicted, but evidence that has surfaced, much of it turned over to defense lawyers by prosecutors and then filed in court with defense motions, has thrown the woman's claims into doubt. Mr. Nifong, so vocal at first, has refused to speak publicly about the case since the beginning of April.

The other day Greta listed several possibilities to explain Nifong going forward with this case, one being that he is insane.

The New Black Panthers are in the community. My guess is that they are threatening anyone who might be on a jury.

Much as Johnny Cockroach brought the Nation of Islam (or was it Fruit of Islam) scum into the OJ courtroom. The message was clear to the black jurors.

All Nifong can do now is to postpone the inevitable charges of prosecutorial misconduct which could well end his career. Perhaps one reason he doesn't want a trial until next year.

Yup. From the article:

Her father, in an interview on Wednesday, said she was in no condition to testify.

Even if the President of Duke made such a call, it would have little effect because Nifong is elected, he's not appointed. In our area, the city attorney is appointed, but the District Atorney is elected. There is no one over Nifong who can convice him to back off. OTOH there are plenty of people, "the minority voters" who might retaliate against him if he DOESN'T go forward with this farce.

The second stripper initially said there was no rape and that the accusation was a "crock" but later changed her story (under pressure?). So which testimony would be introduced? Would the judge (who has a prior relationship with Nifong--I think Nifong was his assistant) be able to keep the earlier testimony out of the case?

Nifong can get a conviction if he can stack the jury with a combination of black jurors and white feminazis.

I don't usually look at Rolling Stone but the other day I was in a library and saw it on the periodicals rack...they had a cover story about the Duke case. Apparently all the white coeds at Duke, apart from a few extreme feminists, believe the lacrosse players are innocent.

One would think so, but some have argued that he may still have some smoking gun that has not been released to the defense yet. At this point it could not be anything other than an eye witness, which few think is possible. Perhaps the process needs to finish before such misconduct proceedings can begin.

Yes, but don't expect any action from North Carolina state people. It will have to come from the federal Department of Justice. The State has no interest in pursuing Nifong.

Mr. Vann said Mr. Nifong could drop the case, but the political price would be high. "He'd have hell to pay from the African-American community," he said. "They'd say, 'Give her her day in court. What do you have to lose? If you lose, at least the jury made the decision.' So he's kind of stuck."

He just a white puppet, dancing on a string. Don Corleone had all the judges in his pocket. It seems the African-American special interests have all the prosecutors.

O J was guilty but he got a free pass. I did not like that but the margin of error should be with the guilty. In our system of justice it is better than one guilty go free than three innocent men be found guilty.

The fact that three innocent men might stand trial because the butt boy Nifong might have "hell to pay" with the African-American community is sickening. Innocent men have been found guilty of crimes they did not commit. But in those cases there was at least a crime.

There was no rape. NONE.

This crime is the liberal's wet dream, rich white boys gang raping of a woman of color and because of that they will not be deterred by the facts.

She is not entitled to "her day in court" unless she is a defendant. I would agree that she needs to be prosecuted for any number of chargess, including filing a false police report, lying to a grand jury, illicit drug use, prostitution, etc.

If she decides to file a civil lawsuit, THEN she is entitles to "her day in court".

How about Black running as an Independent? She would get the Republican votes and the Democrats who voted for her. Nifong might not be normal. Some talking heads have wondered if the AG will step in and take the case away from him.

I'm not 100% certain, but I believe North Carolina has a "sore loser law" (no, not written for Al Gore!) that says if you lose in the Primary, you can't try again in the General Election.
