I interpret it as meaning that she won't be testifying. That would also include a civil suit. If this is true (and of course it's not), this would be a good time to file a civil suit against her.

That would simply give her the excuse she's been looking for to drop this case and say she "misspoke". And you can believe that, at this stage, good ol' Nifong would love to see all this go away.
