The motion says medical records indicate she told a doctor that she used no alcohol or drugs. The accuser told the sexual assault nurse that she had consumed one drink of alcohol and was taking Flexeril, a prescription drug used to treat muscle spasms.
The alleged victim told a doctor the next day at UNC Hospitals that "she was drunk and had had a lot of alcohol that night," the motion said.
She later told police that she had consumed a 24-ounce bottle of beer and then told police she had two 22-ounce bottles of beer, according to the motion.

It's a little vague. He cites the two dates, but my take is that there were six sessions with the police to go over lineups, but that may mean that there were three sessions on the 16th and 21st of March. Of course, that's why they want the material -- to understand specifically what the FA and police did during those line-ups. The records produced so far don't shed much light on what happened beyond hte inability of the FA to pick anyone. Wanna bet that there are more police notes contradicting the FA's claims that the DA has tried to bury?
THe defense strategy here is to drip it out slowly, have a bombshell or three a week go off on Nifong and the FA until the pressure gets overwhelming and the case is dropped. WHen even Nancy Grace is saying this won't go to trial, the pressure us really starting to mount. Even if Nifong doesn't dismiss the case, he and the FA will be thoroughly discredited. As they should be.
This case is a fraud on the public and the courts and has been so from the beginning.

As cynical as I am, I have always had faith in our system because I believe the majority of those people qare good people who believe in what they do.

Between Nifong and people like Nancy Grace and Wendy Tucker I am starting to have my doubts. What about the ones we do not hear about? I hate feeling like this.
Our whole system was set up to protect people falsely accused. At least that is what I was taught in school. The pisser is no one has stepped in to stop this madness.

The argument should be made that, Okay, the only evidence is the word of the accuser and her IDs. I agree, you've convinced me, but following that line of thought, don't you agree we should ALSO charge Kim Roberts. The accuser told police Kim participated in the sexual assault and stole all her stuff (including the $400).
Susan Meadows on Greta, the quintessential liberal reporter,
while reporting on the story quickly defended Kim Roberts. Greta said what role do the documents show the 2nd stripper played, if any?
Susan Meadows looked sick. Then she said that the motions, according to the defense, say that she assisted in the sexual assault and that she stole all her stuff.
Greta reacted to that statement and the left wing Meadows was quick to say: Well, we should say that this was one of many versions and contradicts other statements. Meadows was very dismissive. End of quick segment.
No one mentionedm, well, it would seem that everything Meadows said that should exonerate Kim Roberts or have us not take those charges against her seriously, ALSO apply to the Lacrosse players!
I think if these TV liberals are faced with this question: Will you join me in calling for Nifong to indict Kim Roberts, the second dancer?
I think it'll expose many. Expose their double standards. Expose the traits and suspicions that they attribute IN THEIR MINDS to the priviliged white students, but don't attribute to a black female.
If they don't answer, for example, Abrams could say Georgia, I'm going to ask you this everytime you come on the program until you answer it.
They just had a case in NC where the defendant was facing potential criminal charges and they were trying to start the civil trial and depositions. The Defense lawyer objected to the civil trial going forth with criminal charges still not settled - the Judge allowed the Civil trial to go forward. He rejected all the arguments how the defendant would be placed in legal jeopardy and the criminal process should take precadent.
The defendant was deposed and, upon advice from that defense attorney, he invoked his 5th amendment privileges on every question but name and age.
I have seen Chalmers involved and giving quotes on other Durham crimes during this time he's been AWOL from the Duke thing.
My husband is a cop (or was-retired), my son is a cop, father-in-law a cop,two brothers in law cops,other brother in law investigator for the DOD, both best friends husbands cops---You get the picture..
Anyway the point is that they try to collect evidence and present it to the DA to do as HE wishes. I have no beef with law enforcement in this--It's all NIFONG!!

In regard to post 686, I think I came across wrong.
I was asking politely, Am I wrong? I saw a more recent post from Maggief after being off-line for hours and I meant, Am I wrong about this? Not knowing what was in the couple hundred posts since I had logged off.
I was surprised that they ended up at HIS parents. I missed that in the early News and Observer article or they didn't say that.
If one of these kids had been 1/5 black, the Media pressure would've shut this thing down in early April.
The only reason these 3 are being ruined and their families are forced to finance this entire thing is because of their race.
That's why Hannity and Abrams need to start asking these lib activists pretending to be legal experts or reporters if they will join in an effort for Kim Roberts to be charged in the sexaul assault and robbery. The evidence against her is the same as the evidence against the white students.
I think many of these libs will recoil at the thought of Roberts being charged or have actually participated in the heinious alleged attack. It ruins the whole story for them.
The magic in this story for them is that ONLY privileged white men left to the own devices could do such a dasterdly thing. Roberts participation makes this case unpalatable to them. Now it offends their senses. It doesn't mesh with their pious preconceived notions.
How about the NAACP? How about the motions they've filed in this case? Will they demand Kim be prosecuted to the fullest extent? Will they ask for her criminal history to be used as a determinant in her treatment? Think Je$$e will have a different attitude. The Black Panthers?
From a CNN article earlier in the thread: In court documents filed Thursday, attorney Kirk Osborn said that Durham, North Carolina, police intentionally, deliberately and/or recklessly omitted" information from a probable cause affidavit -- information Osborn says would have persuaded the judge not to file felony charges against three of the players.
