The motion also says the alleged victim told Durham police that she had performed for a couple at a Raleigh hotel hours before the Duke lacrosse party. She told police that she used a vibrator. The motion says medical records indicate she told a doctor that she used no alcohol or drugs. The accuser told the sexual assault nurse that she had consumed one drink of alcohol and was taking Flexeril, a prescription drug used to treat muscle spasms.
The alleged victim told a doctor the next day at UNC Hospitals that "she was drunk and had had a lot of alcohol that night," the motion said.
She later told police that she had consumed a 24-ounce bottle of beer and then told police she had two 22-ounce bottles of beer, according to the motion.

Well, biblically, that should be true, but, in terms of comparative damage, I have to disagree. I also think Nifong is more culpable than Mangum. Nifong preyed on a weak imbecile to make his bones with black voters. All she was trying to do was get out of being committed to the nut ward and thought she'd skate without damaging anybody else the way she has in the past. But Nifong targeted these guys with the intent to go to the mats just to get elected by black Durhamites.
Now, flame away, but one has to wonder if blacks are responsible enough to vote if this is what it takes to get their vote if your skin color doesn't match theirs.

Absolutely. I was just saying that her condition was such that it's easily explained by too much Flex and booze combined, and not necessarily some other drug.
He's in denial most of the time. in fact, anybody who looks in the mirror and sees what he sees every morning and then presumes to show it on TV MUST be in denial.

thank you, I did see that. From reading that and other web pieces on him, I saw that a Public Servant in a relatively poor city is driving a Range Rover and his wife is a stay at home mother.
However, I did not find any articles describing him as priviliged or contrasting his wealth with the poor city that he serves.
It may turn out that there are reasons that Baker is so involved with this Duke case while other mass-murders haven't even had DNA submitted for analysis. While Durham children have been poisoned from the City water, the City Manager Baker remains mysteriously focused on this Duke case. The Durham schools have had issues with Mercury exposure and armed gunmen have taken hostages at or near Durham pre-schools, yet these players are the focus of the Duke City Manager.

Well, if we ever get the full medical report, we might find that out, such as the presence of needle marks.
But keep in mind she does go to school and maintains decent grades, so she may not be a true, hard-core addict. And yes, most, or very many, prostitutes are addicts of one sort or another.
This is probably another reason why I would think that some kind of "no harm, no foul" arrangement will emerge. I see dropped charges for no civil suit, with some token amount going to the AV. It stinks but the defense attorneys have to look out for the best interests of their clients. The other LAX layers of course would be free to pursue Durham and Nifong separately.
Having been on the wrong end of a jury verdict in a civil case that the judge more or less vacated, I would hate to these kids to put their lives in hands of a jury, particularly when the judge has yet to demonstrate his impartiality.

Clearly they did, which is why it wasn't in the discovery. Defense counsel got a lot of this stuff directly from Himan, not in the discovery Nifong turned over. remeber defense counsel asking the judge for the order directing the cops to not discard or destroy any reports, records, messages and notes? That's what lead to much of this, and that's why it's the basis for the motion. Nifong avoided it so he could get his search warrants and indictments.
I dunno. Perhaps he's running it in Chalmers absence, who may have made himself absent because he wanted no part of what Baker and Nifong and Himan are up to.
Work privilege meaning what? If he was in the chain of custody for the DNA samples, you mean the defense could not question him? I understand you couldn't question him on the discussion he might have had on how to try the case, but these are public utterances about supposed facts in the case. Is there a procedural reason why he could not be asked for the basis of his assertions.
Perhaps his mother really is ill and he used that as an excuse to get out of Dodge and disassociate himself from Baker, Nifong, and what Himan did for Nifong.
I understand that! Last year when we went to the beach, there's was this guy that never got up, only rolled over. The kids were saying is that guy dead? He was there all day.
At the end of the week, he got up and he had real long - rasta fan hair or whatever - like Bob Marley.
I thought maybe he should be celebrating the culture that provided for him to lay on the beach all day long and then return back to that big beach front house he went to when the day was over.
If he wanted to divorce himself from the DPD's malfeasance in the case, that'd be a good way to do it, also without having to blow the whistle on Nifong and baker, etc.. "See no evil, hear no evil, ....etc..."
Nancy Grace is suggesting Nifong should have the judge not allow the 2nd strippers first statement to the police that she was with the FA the whole time but 5 or less minutes. Guess Nancy doesn't mind peoples cases getting overturned like some of hers were.
