The motion also says the alleged victim told Durham police that she had performed for a couple at a Raleigh hotel hours before the Duke lacrosse party. She told police that she used a vibrator. Osborn suggests that could be the source of the vaginal injuries mentioned in the rape kit report. (snip) Osborn says the accuser gave conflicting accounts of what happened. The motion says medical records indicate she told a doctor that she used no alcohol or drugs. The accuser told the sexual assault nurse that she had consumed one drink of alcohol and was taking Flexeril, a prescription drug used to treat muscle spasms.
The alleged victim told a doctor the next day at UNC Hospitals that "she was drunk and had had a lot of alcohol that night," the motion said.
She later told police that she had consumed a 24-ounce bottle of beer and then told police she had two 22-ounce bottles of beer, according to the motion.

Reading Jarriel Lanier Johnson's statement:
It looks like Maggief was right - there was a disagreement.
But, Jarriel isn't telling us something. He says she suggested they go to a local carwash. He drives his car there and starts washing it and she makes a call. He then says "I told her I was taking her home". He doesn't tell us what angered him at the carwash. Why, suddenly did he want to take her home. Was it her phonecall or the person on the other end of that call?
So, in my opinion, he's taking her home because he's angry at her. She says she has to pee. He pulls over (on a busy road). She starts walking and he continually asks her to get back in the car and she's telling him to leave her alone. This is repeated several times. He gets her back in the car and he THEN drives her to his parents home. He says, "we went back to my parents house where we talked it out" She wasn't supposed to go home, he was taking her to her house out of anger (IMO).
The point is Jarriel is editing certain things out of his statement.
The statement is much better than the News and observer article.
You are right there. It has taken these so much to come around. It is scary.
I recorded an Abrams show in March. On that show, Abrams was criticizing the lacrosse players. He was talking like it happened. Granted, he quickly came around when faced with the evidence.
Wonder what Gilfoyle saw to make the statement that the accuser may have a serious mental health problem.
Kimberly was wholly on the side of the accusor for quite awhile, right along with that ghastly Wendy Murphy and Nancy Disgrace.
Then I place the blame on the citizens of Durham...they elected him! Everyone agrees this guy is a complete idiot, yet no one is calling for a Republican to run against him in the upcoming election. I think there is a larger story here than just Nifong.
It seems Jarriel was negligent in his pimp duties by allowing the other guy to take her to Buchanan. It's his job to make sure she maintains a certain level of professionalism - meaning not showing up for a gig completely wasted.
Now it's looking familar.
I think Maggief stated this earlier. She spills her drink on his cell phone and he takes her home (again, he doesn't mention he was angry, but it sure looks like that's what is going on) Later, when he notices his cell phone is not working (see spill above) - he says he calls her
and tells her that he is not able to take her to what turned out to be the Duke Party.
It seems Matthew is over and above Jarriel in the pecking order. In his statement he mentions that he is driving to pick her up at her parent's house. When he gets near the house, he gets a call from her saying that Matt is coming over to bring her something. Jarriel then goes to a carwash and waits for 1 -1.5 hours until she calls him and tells him Matt is gone. When Jarriel gets there her daughter lets him in, he waits with her kids while Crystal showers or gets ready.
One thing though: I think Jarriel avoids some controversial subjects in his statements. He mentions them getting Chinese, but never mentions them buying liquor or beer.
I think I'm a little late to this conversation - it sounds real familar now.
Here is the GREAT MOTHER. Remember, we where chided for not calling her a Mother. Look at this timeline and consider this woman was a Mother with two young kids. Where is Gloria Allred and Lisa Bloom about these children? Mustn't
fit the template.
Day 1
Mom leaves home at around 2:00 in the afternoon for a job at a Hotel. Later that afternoon, her driver picks her up and both of them go back to her parents house.
At 7:00 pm they leave again - together.
Mom gets home around 7:00 the next morning.
Day 2
Approximately 4:00 in the afternoon, another man (Matt) shows up at her house. They spend approx 90 minutes together. Crystal later says she had sex with Matt during this timeframe. Matt leaves and Crystal gets a shower or gets ready. While she is getting ready Jarriel shows up just 5-10 minutes after Matt had left. Her daughter has to let Jarriel in.
Around 6:00 pm, Mom leaves with Jarriel and is gone for the night.
Day 3
Mom finally comes home around 4:30 in the afternoon. Mom leaves again around 8:30 that night
Lacrosse Party
Day 4
Mom home with "boyfriend" before noon and, according to her Father, parks her car and leaves in his with him.
Looking at the aforementioned and several things come to mind:
1) What kind of environment are those kids growing up in?
2) How can her Father claim ignorance? Men are coming and going and she's gone all night long on multiple nights - consecutively . She doesn't even go home in the morning when she finds an older man interested in seeing her "perform". She is eating Chinese in Motel rooms.
3) This timeline shows that Crystal was most likely acting when she was crying about having to get home to her kids. She's never with her kids. We have to assume she sleeps at some point. Her "schedule", if you will, is to be out all night. Was her behavior and reaction about her children that need to be cared for, a reaction to her understanding that she was headed for a Psych Ward? Was she aware she would be kept for observation? Was she thinking back to her previous stay in a Psych Ward in 2005?
4) Have to wonder about that household. Jarriel says in his statements that her daughter let him in. He says he played with the kids while Crystal was getting ready. He never once mentions Crystal's Mother or Father. In interviews, the father has called it HIS home. I don't know that the Mother lives there.

Judge dismisses noise charge
DURHAM - A judge dismissed a noise ordinance violation charge filed against a Duke University lacrosse player.
Erik Steven Henkelman, 22, was charged Aug. 24 with violating the city's noise regulations.
The court deferred prosecution of the case until this month. On Friday, a judge dismissed the charge.

DURHAM - More lawyers are protesting District Attorney Mike Nifong's quest for personal information from Duke University lacrosse players not charged in the rape case.
Nifong issued two subpoenas May 31. One asked Duke officials for home addresses for 47 lacrosse players and two other students. The other sought electronic identity card data that could track where they were in the hours before and after the alleged rape
Julian Mack, a lawyer representing Robert Wellington, a sophomore from Dallas, and Jay Jennison, a sophomore from Richmond, filed motions in court Friday asking that Nifong's subpoena be quashed.
Bill Thomas, a lawyer representing Bruce Edward "Bret" Thompson, a senior from Chevy Chase, Md., filed a similar motion late Thursday.

Ruth Sheehan and Barry Saunders are besides themselves seeing this trend in the Durham courts. I can feel the anxiety growing in that Newsroom.
There's a lot of alleged "journalists" that will be held to account after this story's over...
Keep those motions going. I hope 46 different motions are filed in varying ways.
This case has turned into a nightmare for those that demanded it and those that gave it life.
Watching the female reporter, Meadows, on Greta V.S., these people are barely making it. They can barely bring forth the words. This case has devolved to the point where they want it to go away!
I think if David Evans held a press confernce on Monday, about 10 journalists would commit suicide.

As the mother of a Duke University lacrosse player, Tracy Tkac endured her worst moment while watching the news at home in Gaithersburg. There on national television was her son Chris's face on an outlaw-style wanted poster.
A woman hired to strip at a team party had told police she had been raped by three lacrosse players, and the police in Durham, N.C., accused the team of stonewalling the investigation. "Please come forward," said the poster, which featured nearly every one of the 47 students on the team and was shown hanging on a campus wall.
"The people that I entrusted my son's education to, allowing those posters to go up on the walls of their private institution," Tkac said.
In Chevy Chase, Sally Fogarty and her husband, parents of Gibbs Fogarty, hunkered down, avoiding social settings where the Duke case was the topic of discussion. "I could not risk hearing my friends express doubt over my son, because I was afraid the friendships would be ruined," Fogarty said.
John Walsh watched what he called a "rolling tide" wash over his son Johnny's team in a presumption of guilt. "In a fell swoop -- a lightning bolt -- everything is taken from them," said Walsh, a health administrator who lives in Bethesda.
Feeling abandoned, angry and distraught over their sons' futures, the parents bonded most through the shared conviction that everyone on the team is innocent.

Very possible, but she'll have a judgment haunting her for years. It's getting harder and harder to discharge debts in bankruptcy. If she ever wants a career beyond hooking, and I presume she does or she wouldn't be going to school, her wages will be garnished, she won't be able to get a loan, etc.,
LOL! It certainly would be a great question to hound them with!
