Defense Calls for Evidence in Duke Rape Case

Lawyers representing one of three Duke University lacrosse players charged with rape want details about any toxicology tests performed on the accuser, asking in a motion filed Monday whether such evidence even exists.

"No such toxicology report, if it exists, was provided to the defense," wrote attorneys Kirk Osborn and Ernest Conner, referring to nearly 1,300 pages of evidence prosecutors provided to defense attorneys last week. The attorneys represent Reade Seligmann, one of three lacrosse players charged with raping a woman hired to perform as a stripper at a March 13 team party.

Seligmann's attorneys want a judge to order prosecutors to provide any reports "generated from blood, urine or other biological samples" collected from the accuser. In the motion, they cited a story published in Newsweek earlier this month that said District Attorney Mike Nifong "hinted" such tests would reveal the presence of a date-rape drug.

Authorities have said a doctor and specially trained nurse performed a physical exam on the accuser that found evidence of sexual assault. But the nurse who filled out a report on that exam indicted no toxicology tests were performed, according to the defense motion.

Nifong declined to comment.

Alan hopes Nifong has something, anything, to keep him (Alan) from looking like the fool he is.

Here ya' go, Alan: No abrasions, no tears, no bleeding. No DNA, no broom, no condoms, and no date-rape drug. At least five prostitution events in the two days prior to the alleged rape, plus her boyfriend, plus the guys who drive her around.

It looks to me like every guy in town used her for a Kleenex EXCEPT the lax guys.

I can't believe they even brought charges in this case. No DNA, no evidence of tearing or bleeding, just some swelling and tenderness, 5 "dates" plus the boyfriend and 2 drivers, she initially said she wasn't raped and changed her story repeatedly first claiming 15-20 men raped her then saying 3 did and on and on. And that isn't even addressing the exculpatory evidence the defense has. Sheesh. Someone really needs to stop this thing.

Even if they did not do it, somewhere white boys raped a girl of color and got away with it so what is the problem if these boys are brought to trial for something they might or might not have done. Whose to say what justice is for who.

DURHAM, N.C. -- It has been six months of grief, frustration and few answers for Lennis and Donna-maria Harris.

On Nov. 19, 2005, their son, 24-year-old Lennis Harris Jr., was shot to death along with three friends at a townhouse at 2222 Alpine Road in Durham.

The family is still waiting on results of DNA samples taken from the crime scene, and said they are frustrated by all of the attention surrounding a rape investigation involving three of Duke University's lacrosse players.

"We were absolutely livid to find out that the DNA from the Duke rape case was being tested again by an outside agency that was being paid for," Donna-maria Harris said. "And we want basically the same kind of treatment."

Although the Harris family does not believe Durham police see the quadruple homicide case as a top priority, Durham City Manager Patrick Baker has said otherwise.

"(The Harrises) raise a very good point," Baker said. "To me, it is a high priority, and I will be meeting with Mr. Harris and listening to his concerns."

Baker said police are in the midst of the investigation and that, just as in the Duke lacrosse rape case, a full-time investigator has been assigned to it. He also said he hopes an arrest will take place "very shortly."

A call to the Durham Police Department about the investigation was not immediately returned.
