Nifong is bound to try and discredit the photos. He will have to make the attempt.

The boy's lawyers knew this the moment they first got the pictures. I am sure they are ready for any argument Nifong tries.

The battle would happen anyway, no matter what.

Nifong has a lot more problems than just some photos, anyway. Photos he didn't want to see, remember.

I don't think Nifong has any real evidence whatsoever except CGM's word. If he had anything big, he'd have trumpeted it all over by now.

His inexperience is causing him to think he has great evidence in things like the SANE report, and the almost but not quite DNA on the fingernail, but more experienced lawyers will school him on that.

It is his inexperience that is showing in his failure to look at the photos, failure to examine the phone, his claim that the DNA would reveal the attackers, etc.

This is all inexperience showing.

He hasn't got a clue how to run this thing, and it shows.

It will really show in court, I hope.

I guess what I can't seem to bend my mind around is the obviously mountain of evidence Nifong is overlooking. In our situation, we even had a witness 18" away from the girl and my son who said nothing happened. We had at least three witnesses she blabbed to the week before she pulled her stunt, and the D.A. still pressed charges. I can't even imagine why.

Here, there appears to be voluminous evidence that Seligmann, at the very least, wasn't involved. The fourth I.D. the AV made wasn't even in town. The DNA on the fingernail was due to Evans trying to be helpful, and we've heard rumors that Finnerty's alibi is as tight as Seligmann's. Additionally, she had intercourse with one or more individuals that evening and none of the DNA matched any of those arrested. Yet, nothing, nothing seems vaguely exculpatory to Mr. Nifong. I understand that once charges are filed, it is up to the Prosecutor to fully examine all the evidence as it's the State, not the AV who is prosecuting those charged, but this passes all credibility. Not quite as much as our case, but there were, in fact, 30 or so witnesses to say nothing happened. We only had one.
