I heard something about the defense trying to get a dismissal by a judge before it even goes to trial. I'll see if I can find anything.

CGM would be admitting her injuries might not have come from an assault if she accepts a settlement for falling down the steps.
That would of course be the point.
She's not likely going to be allowed to admit that by her lawyers.
Her lawyers do not care in the least bit for what reason they get their cut, ie 30%. Nifong might not be happy but her tort lawyers want to get paid.

She's being directed by handlers who aren't going to allow any suggestion that there was no rape, imo.
Nifong would look a whole lot worse than he already does, as would many other folks who have supported her.

JLS, I think it's CGM who will want to get out of this whole thing in a little while. She's the one who is likely tlo crack. I think the boy's lawyers realize what a time bomb CGM is for the prosecution.

She may well. The only points I have been trying to make concerning settlement possibilities are:
1. It is easy for us to sit at our screens with nothing at risk and say they players should not give her one cent.
2. A settlement say for the fall she took at their house is not an admission of guilt. Settlements never are an admission of guilt. Settlements are an admission that it is cheaper to pay off a pest rather than fight them.
I sort of don't want the accused to settle this case either. I don't want her to be rewarded. Another point I guess I should make here is that in many cases people says they will never settle before they eventually do.

But I think she might refuse to testify, if she thought she could more quickly settle any case she has due to her fall at the house that night. This is the way Bryant got rid of his pest, Faber.

Certainly she has handlers that would not want her to refuse to testify. On the other hand she does not impress me as someone who is greatly concerned about the interests of anyone but herself. And once she has a tort lawyer, he may trump other handlers as his interest becomes settling the case not using it as a political statement. Nifong can not look worse than he already does.

Nifong can probably make CGM testify. He almost certainly has something he can use against her. Some old charges or something.
Which raises the very interesting question, would he? Is this a personal issue between Nifong and Duke or lacrosse players? Or as every one who assumes he is rational says, does Nifong want out of this mess?
If he wants out, then he would ring his hands and say alas the woman is too distraught to testify and never have to present his weak case. If it is personal, then you might be right about what he would do.
