DURHAM, N.C.One of three Duke University lacrosse players charged with rape wants the case resolved in time for the next school year, his lawyer said in court yesterday. But the judge warned he will not fast-track the proceedings.
The case "is not going to jump ahead of the line and be handled any differently," Superior Court Judge Ronald L. Stephens said at a hearing for sophomore Reade Seligmann.
After the brief hearing, District Attorney Mike Nifong said he does not expect any trial to begin before next year.

I'm not trying to be difficult, but I really can't figure this out. The supposed attack happened on the 14th and the search warrant and recovery happened on the 16th and at that time the players didn't have lawyers. The discovery info was released to the lawyers yesterday, yet yesterday the lawyer already knew the service had been discontinued the day after the alleged attack.
Well, to make it simple: When you lose a cell phone, you automatically call them and terminate the service. This could have been the accuser or her pimp/boyfriend. When the guys picked up the phone in the yard the next day, they tried it and it didn't work. That's how they knew.

The bigger question about the cell phone should be: "Did the guys who found the phone at least check all the phone numbers and contacts, to see if any District Attorneys or judges were on her client list?"

Since the boys found the phone, they might have tried to call the owner to try to return her stuff to her. They could have looked through the numbers in the phone and found a home number or a work number and tried to call CGM or her employer.
No biggie.
Assuming they knew the phone was disconnected before discovery day.

My contention is that if one is brutally gang-raped, kicked, beaten and strangled - CANCELLING your cell phone service is not a priority when you're still recovering from physical injuries.
In fact, to be consistent with the victim of a heinous crime with a stolen phone - supposedly by the same perpetrators - the phone would be left in service in order to bring the perps to Justice.
The very day she is released, she can't make it to the police and can't provide them any details, but she can remember to cancel her phone service.
I think the phone service was cancelled so that others in the AV's inner circle would not be identified by the authorities. I'm sure they were not thinking Defense at that point - but the authorities. Kim had a warrant out for her arrest, did the AV's boyfriend also? Was this overriding impetus for canceling the phone service?

My thoughts exactly. The lives of those young men are going to be on hold and in ruin until then. Given the accuser's lifestyle, I don't know if she'll even be alive by the time the trial begins.

I would think that the Hooker 101 book would state that when you lose your phone, you cancel it immediately so incoming calls cannot incriminate you further.

Everyone around the AV seems to be acting like criminals. Covering their tracks, using phones registered to others.
Not admitting to making 911 calls, etc.

It was reported before the hearing that the defense was trying to secure time sensitive evidence. The defense went into court ready to seek the cell phone records and acknowledged they had just received discovery. So (IMO) when they stated the phone was discontinued the next day, they already had that info.
one advantage of all the time it takes to get to trial is that the truth has a way of being exposed, while in a really speedy trial, it would be a victim of the slickest talker.
