The article is closer to correct.. I don't know what Greta said, but the Judge said for the two attorneys to get their experts together to obtain the information from the phone and bring it to him... He would then look at it in chambers and decide which of the stuff would be admitted...
It was the judge that brought up the 3rd party ownership...

Sorry for the delay. I'm been away from the puter, but I have caught some of the TH's tonight. (I really must avoid Nancy Grace. I find myself reciting the Serenity Prayer when I watch her.)
Pay no attention to the caption that ids the picture as Kim. It's probably a poor website design. That is not Kim -- it's Crystal.
Crystal and Kim don't look anything like each other. Kim looks like a female Tiger Woods. Crystal looks like her mother. Check the posts upthread where posters discussed the tattoo on Crystal's arm.
Actually, the judge basically granted the order, but he wants to look at the product from the phone in chambers before releasing it to the defense for their use or distribution to make sure that a third-party's privacy isn't being violated. This seemed like a reasonable decision. He asked both defense counsel and Nifong to put together an order (to gather the records from the phone). If they couldn't agree, they are each to submit their own order and he will pick one or design his own. I expect much of the data on the phone (independent of the calling records) is already lost, although any photos MIGHT still be there.
