DURHAM -- Lawyers for accused Duke lacrosse player Reade Seligmann want a judge to hold hearings Thursday on whether to compel police and prosecutors to turn over the evidence they've compiled while investigating the alleged gang rape.
The motions have to be heard now because there's a risk that evidence that could exonerate Seligmann "will spoil if not preserved properly," lawyers Kirk Osborn and Ernest Conner said. They said that could happen due to political pressure Durham officials might be putting on investigators.

The civil rights claims the players will have against the city keep getting stronger and stronger every day.
That is the real reason this charade continues. If it goes to trial, it would help a defense against future civil rights actions against the city.
On the other hand, the egregiousness of the prosecution may make a future jury award in favor of the players even larger.

If,by chance,both these questions require the answer "yes" then there's a very viable scenario here that doesn't at all fit with the accusations made by the woman. I think you can easily imagine what that scenario is.
Among the most difficult things for a parent to do is to recognize and acknowledge that their son/daughter is a bum.
I think there's a distinct possibility that this gal's a bum.IMO,DNA evidence (or lack of same) will tell the story.

Nifong only "releases" tiny bits and pieces of the information and the press just runs with it like the fools they are.
I thought it was interesting that he used the phrase "immediately before the exam". I took that to mean the defense thinks it happened after she left the Duke party. I'm not up to speed on how closely an exam can pinpoint the time of deposit, so I'm just speculating. AFAIK, there's no ATM camera for those kinds of deposits:)
Can Nifong hunker down and let the passage of time solve his problems as Thomas Sowell suggests? Can he publically be called dishonest and unethical as Cheshire did and not respond? Does his "expletive laden tirade" against his public defender Kerry Sutton mean he's more likely to break under pressure than the unstable accuser?

One of the DNA experts said that his impression was that the returning DNA on the plastic was so vague, that it could be matched to millions.
I would bet that Nifong did not cross match the plastic DNA to the FA's DNA.
Or Kim's DNA.
The worst possible thing that could happen to the players right now would be for the case to be dropped for ANY reason. If it would be dropped then there would always be doubt.
It is now best that they go to trial and clear themselves, even as distasteful as that notion is.

Kerry Sutton represents a player, but she has also praised Nifong's fairness and vouched for his integrity. She publicly backed his candidancy, even to the point of showing up at the polls waving a "Vote for Mike" sign.
That he would publicly lambast her for merely appearing at Friday's presser tells me how unhinged Nifong is.
Of course! And I wouldn't be very happy (read understatement here) if my daughter was a stripper. But I imagine things are getting so confusing down there for everyone that folks just know that they're in the heat of the battle. I think this woman has a huge problem on her hands and the more I hear, the more I think it is of her own making. But the media (not just the defense) has come down hard on her credibility. As a parent, it would rip me apart, regardless of the circumstances. I think it's the fault of the DA, however, who has put the defense in the position of having to do this. Regardless of her credibility (and I really don't think she has much), I think what the DA is doing to EVERYONE in this case is absolutely shameful. But I was responding to how I think I would respond as a mother to this young woman.
I don't think I said what I meant to say very well here. If I was the parent, I certainly wouldn't make negative public statements about my own daughter. Especially in response to a political DA. I would probably defend her, especially if someone had stuck a microphone in my face, just because she was my daughter. I don't assume that what the parents say publicly reflects what they think privately. That doesn't mean they're not honest. That's another question and I don't know enough about that to make a true assessment. But I wouldn't spill my private thoughts to a public that is going wild about my daughter. I just wouldn't.
I saw an interview with the parents. I can't remember which news station did it but the reporter was at their home and outside with them. He was african-american so I assumed they didn't feel threatened in any way and granted the interview to him. I don't mean to put anybody down but, if your heard her parents speak, you would think that they didn't make it to high school. I think they are very poor, uneducated, and I sort of felt sorry for them. They gave me the impression that they are simple people. They looked like they wouldn't harm a fly. Maybe some of you have seen them in other interviews, but I haven't. Am I getting the right impression??
From what I have seen of him on the local TV, I think you may be exactly right.
Yesterday I saw what you described. They seemed sad and tired to me. I think they realize their "baby girl" has once again gone astray, but don't know how to help except speak to the press when some new info casts doubt of her story.
They didn't strike me as ones who would turn down a community leader's offer to publically speak for them, so the absence of a spokesman/defender suggests this is nowhere near the first time the accuser has found herself in trouble.
