Hubby says 1st degree kidnapping in this case means detaining her against her will on top of another felony--the rape.

He's not possitive, because he's familiar with CA. law, not NC law.

I laughed my butt off when it was explained to me last time. I thought "you mean when I sent my kids to their room and did not let them come out, I kidnapped them?" :-)
