Nifong has changed his tack and he's gone from saying the
first 911 call was corroboration of the mindset of the
lacrosse players on that night TO the first 911 Call, "as
far as I'm concerned, it has no direct bearing on the
situation".

This is 24 days after the alleged attack. Nifong signs
indictments against 2 players FIVE days later.

I don't think it's harsh at all, but realistic. And what's more, practical, in the wake of the Duke case. If you're a white guy and you hire a stripper/prostitute, make sure you get a white one. That way, if something awry does happen, at least the race card is out of play.
