Can we dare to hope and pray it never reaches a jury?

There are a number of ways that this can happen. I am not sure the probabilities of them:

1. Nifong now elected lets the case drop after it drops from the headlines. [This could happen under the threat of 3 below.]

2. The woman recants, refuses to along go along or can not go along.

3. Nifong is removed from the case by a judge and new prosecutor from out side Durham is assigned and drops the charges.

4. A judge throws out the IDs and dismisses the charges.

5. A judge dismisses the case before it goes to the jury because the prosecution fails to meet its burden.

Care to add some more reasons or assign probabilities to each of these?

Are judges in Durham elected or appointed?
