They've already quit. And they've called and given a two day notice of taking the day off. According to our company policy I CANNOT fire them, unless we'd like to hand over our company to them, with the blessing of the court.
This is California. If there are any CA,NV,AZ,TX folks on here, I would have to say, they may understand this a little better. We are literally at the pointy end of the spear, and we live it every day.

Coors has a similar policy as well. An employee can take a day off with proper notification given ahead of time. It's referred to as, "Personal Leave."

Actually - you should have it in your policy - that they need to call in directly - since someone called on their behalf you "technically" dont really know who called in -
Also there's no requirement for you to approve the time off even if they requested it.
You can also let people go even if they give notice. "Thank you for your service, we are no longer in need of your service, here's your paycheck."
-Not that I'm telling you to do it any differently than you are doing it, and kudo's for calling the CHP - but sometimes people are afraid of terminating and at the end of the day, you're still the employer and do have at least in theory some rights - even in California. :)

Before you say "Fire them" Know that everyone involved has already given two weeks notice over this past week. We're already looking for replacements.So they were already leaving and had resigned en masse?
