If what has been said about the identification is true and no DNA match is ever established, you may be waiting in vain. The case may never go to trial. Probable cause is a very low standard and is all that is needed to get by the Grand Jury. The accuser's statement alone gets that. Proof beyond a reasonable doubt is another thing altogether. They need some proof that a specific individual attacked the accuser. Proving the accuser was attacked by some unspecified Lacrosse player is not sufficient to get this case to trial.
I say this not to be contentious, but because I really believe the case will not go to trial and that is a terrible outcome, because it settles nothing. Since the case has now been tried in the media, supporters of each side will continue to believe as they do and the accused young men will be hounded for the rest of their lives, guilty or not.
On the other hand, a trial like that for O.J or Robert Blake would do little to dissuade those who think those men guilty of murder. I doubt, however, that a North Carolina trial would be as screwed-up as a California trial.

Can the City of Durham be sued by the defendants? I would think this information would help. What charges? False arrest, defamation of character, ???? Does the case have to go to trial before that can happen? If it's just dropped, are they out of luck, or might they still have some recourse?

I am convinced that parents who feel that their children do no wrong are responsible for raising children who are consistantly in trouble.
My children are grown. I used to feel guilty for "laying down the law," when raising them, but now I look back on friends, neighbors, and aquaintances who didn't, and their kids now have problems.
If protocol was followed and she answered truthfully this case could never have been brought.

That was my first thought also and after talking to my b-i-l who is a doctor, said almost the exact same thing...
Remember the other girl has suggested a date rape drug was used...I would like to know how she can remember and testify to what happened and who did what, when where and how, if she was fried by a date rape drug? I have read and heard that the person really konks out and cannot even remember what happened, if they are drugged with one of these things.
