The woman who says she was raped by three members of Duke's lacrosse team also told police 10 years ago she was raped by three men, filing a 1996 complaint claiming she had been assaulted three years earlier when she was 14. Authorities in nearby Creedmoor said Thursday that none of the men named in the decade-old report was ever charged but they didn't have details why. A phone number for the accuser has been disconnected and her family declined to comment to The Associated Press. But relatives told Essence magazine in an online story this week that the woman declined to pursue the case out of fear for her safety. The existence of the report surprised defense attorneys, one of whom has sought information about the accuser's past for use in attacking her credibility. "That's the very first I've heard of that," said Bill Cotter, the attorney for indicted lacrosse player Collin Finnerty, who along with fellow Duke sophomore Reade Seligmann is charged with first-degree rape, kidnapping and sexual assault. He declined additional comment. Attorneys for Seligmann asked the court this week to order the state to turn over the accuser's medical, legal and education records, and hold a pretrial hearing to "determine if the complaining witness is even credible enough to provide reliable testimony." The accuser, a 27-year-old student at North Carolina Central University in Durham, told police she was hired to perform as a stripper at a March 13 party, where she was raped by three men. According to the Creedmoor police report in August 1996, when the woman was 18, she told officers she was raped and beaten by three men "for a continual time" in 1993, when she was 14. She told police she was attacked at an "unspecified location" on a street in Creedmoor, a town 15 miles northeast of Durham. The report lists the names of the three men, but no other details. Creedmoor police Chief Ted Pollard said Thursday he had no recollection of the report, and his staff has been unable to find any additional information about it. Durham police Officer Brian Bishop, who interviewed the accuser in 1996 while working on the Creedmoor force, said Thursday he had a vague recollection of the report but couldn't remember any details. When asked about the accuser's previous report of rape, Durham County District Attorney Mike Nifong declined to comment. Before Seligmann and Finnerty were indicted, attorneys for the players pointed to the accuser's criminal history when answering questions about their clients' legal troubles. The woman pleaded guilty to several misdemeanors in 2002.
You are right, OakOak.

Hey there! Welcome to Free Republic : )
I want to put this question sensitively, since you know Crystal. Is this whole mess out of character for her, or is she in the habit of getting in trouble on a regular basis?
You are too kind.
:)
Dad drove the AV to buy soda and candy before the party.
I believe the boyfriend drove her to the party.
Some have said, can't confirm, the boyfriend was with her or drove her to either the psych ward or the hospital.
The boyfriend drove her home from the hospital.
There's not much reported on the boyfriend. (I've sometimes wondered if it's the ex-husband.)
I don't know the FR thread, but here's more info.

COSBY: Her boyfriend brought her to your home that day. What time on the 14th did he bring her to your house?
UNIDENTIFIED MALE: About 11:00 oclock that day, on the 14th.

1:22 a.m., (Police report) Durham Police called to Kroger store on Hillsborough Road. Durham police received a call from a security guard at a Kroger grocery store located on Hillsborough Road. The guard told the 911 dispatcher that woman named Kim, the second dancer at the party, pulled up and was worried about her friend. She said the accuser did not smell like alcohol.
About 1:30 a.m., First officer to arrive at the Kroger tells the dispatcher: "She's 10-56 and unconscious." The radio code 10-56 means an intoxicated person. The dispatcher asks: "You need a medic truck or are you 10-4?" The officer replies: "She's breathing, appears to be fine, she's not in distress. She's just passed out drunk."
About 1:35 a.m., Second officer arrives and takes accuser to nearby psychiatric hospital (substance-abuse center). Officer referred to Durham University Medical Center (DUMC) Emergency Center.
1:58 a.m., An e-mail talking about plans for a party that would involve killing dancers is sent from a computer located in 2C Edens Dorm, according to a Durham police search warrant. The e-mail is signed "41," which is lacrosse player Ryan McFadyen's jersey number.
2:31 a.m., Accuser arrives at DUMC emergency room. Staff evaluation indicates possible sexual assualt. Sexual Abuse nurse is summoned.
2:50 a.m., Durham police initiate "rape investigation". Accuser submits to 3-4 hour rape kit examination by a physician and a Forensic Sexual Assualt Nurse (SANE) at DUMC. She is likely given a battery of blood and urine tests. According to the DA, Mike Nifong, a hospital report later showed that her injuries and emotional state were consistent with having been raped.
She probably won't step up and do the "right thing", but you never know. I do know that those young men are forever tarred and feathered by this scandal.
If it takes a civil trial to get the truth out of her, then so be it. If drugs and alcohol are behind her behavior, then a 12 step program is in order. That's for starters.
"I have NEVER said this in my life, other than this case, but, I fear the authorities may tamper with evidence in this case."
Exactly.
Which is why the players must shut up and not volunteer any info or evidence they have, until they hear what the DA
claims to have on them.
(For example, I am suspicious that it was the two richest players on the team who got hit with the rape charge. That (possible) scheme hit a snag only because those two players could produce proof of their whereabouts.)

UNIDENTIFIED MALE: Well, she (INAUDIBLE) like she was in a lot of pain, and her face was swolled up. She had bruises on her eyes. And she just looked awful, and you look at her, you could tell she had been beaten up........
******
Game set match--I am assuming Daddy would be asked about those statement on the stand. Dan Abrams would have mentioned her face if it looked like she was in the ring with Evander.
The officer at Kroger is not blind...he would have noticed it also.
About 65 miles - Creedmoor is north of Raleigh and Kenly is southeast of Raleigh.
It would be interesting to know the make, model, and COLOR of the AV's car.
A couple of points:
1. The ex and then financee being related to the chief of police might explain why she felt forced or felt safe enough depending on your point of to make a weak complaint in 1996 of an incident from 1993.
2. The second officer taking her to the ER may well have been the DPD following a rule and putting her in the hands of a female cop as soon as possible once she claimed rape.
Why is Duke even allowing these racists to march at their campus?
Their students don't seem to be a priority for them.
It will be interesting to see what the yield will be for Duke when all the acceptance checks arrive. They may have to deep way in to their waiting list.
Maybe he used to. Nifong's future is going to get very interesting.
A report of a 14 year old being raped by a 21 year old.. where she's named three rapists...in a town of 2000. Sure, just a report! I have a bridge to sell you.
