Lacrosse players face old charges (Nifong retaliates against Duke Lax)

DURHAM - District Attorney Mike Nifong plans to reinstate misdemeanor charges against a half-dozen Duke lacrosse players, saying a March 13 party where a woman reported a rape broke the deals that the players made with prosecutors.

Nifong's decision could affect players who, before the party, had entered agreements in which prosecutors would dismiss the cases if the players performed community service and stayed out of trouble for six months or a year. Among the first to have his charges reinstated was David Evans, one of the team captains who lived at 610 N. Buchanan Blvd., the site of the party in which lacrosse players hired two women from escort services to dance. One of the women told police that she was raped by three men in a bathroom.

Two players, Collin Finnerty, 19, and Reade William Seligmann, 20, were charged last week with first-degree rape, first-degree sex offense and first-degree kidnapping. Their attorneys say the men are innocent.

On Monday, an attorney for Seligmann filed a motion seeking information that would help attack the credibility of the woman, the only person, according to the defense filing, who says a rape occurred. The motion seeks information about the woman, including criminal charges, mental and emotional problems the woman has suffered as well as social services, probation, child protective services and victim's advocacy records.

Today, Finnerty is due in a Washington court where prosecutors in an assault charge are considering whether to revoke a deferred prosecution agreement similar to those affecting other players in Durham.

According to court records, 16 players were charged in the past three years with misdemeanor charges in Durham including noise violations, public urination and alcohol violations. The deals placed the men on probation for either six months or a year.

I have not seen him on any of the shows, I don't think it is worth the time. But I suspect she is not letting him but rather in the spirit of Locomotive Breath's post on behavior, he is behaving just as you might expect. From what I have read about his appearances, he does not sound very sober.

He is either senile or a druggie or an alkie etc and all of a sudden these TV people what to talk to him. So he goes on and talks and talks and talks etc. She probably could not shut him up, if she wanted to.

Wisdom is earned the hard way; it's not innate. Most kids are still foolish at age 20, especially those whose hormones are running rampant and those who've lived safe lives and haven't had the opportunity to earn that wisdom.

I cannot say I agree with you. Please do not accuse him of being a druggie or an 'alkie', based on the way he talks and acts. Sure he may some senility, but consider his age. And consider this: the father no doubt loves his daughter very much, and this media attention is very hard on him. I would think he is worn out about it, and it shows in his voice and demeanor. And I think he is very sad about his daughter, what he is finding out about her. I say give the old guy a break, and not drag him into this. I feel sorry for him.

I said something about Alpha Phi Alpha. Is that what you're referencing? It's a historically black traditional frat to which xoxo had put up a link. Duke has a chapter and so does NCCU. The other one with which I'm familiar is Omega Psi Phi.

IIRC Alpha Phi Omega is a service organization open to all.

OT:

I'm not sure that engineers have a frat as such, but engineers have honorary society Tau Beta Pi which is the Phi Beta Kappa equivalent. If you look in front of the Hudson engineering bldg at Duke you'll see the "bent" which is the symbol of PBK.

Bent

The pledges are made to go out and polish the bent each year. It also leads to a lot of "let's get bent" jokes.

Electrical engineers have Eta Kappa Nu. The initiation ceremony is a hoot. Everyone assumes an identity: "Brother Ohm", "Brother Volt", etc. We could never do it without cracking up. Oops! I gave away the secret ceremony. I guess I'm out. The Civil Engineers have their own as do the Mech. E.'s, etc.

There was no planning by the "strippers" the AV was whacked out of her mind in the back of a police cruiser when the rape idea hit her. She may have child custody issues, other legal problems or simply wanted to avoid being thrown in the drunk tank. Viola! Rape.
Her story and Kim's have never matched up well, the lack of DNA has caused all kinds of new ideas to come out of her head--brooms especially. The einey, meeney, minny moe line up bought her/Nifong some more time before the inevitable collapse of the story.
I keep reminding everyone that the alleged perps had private detectives on this very early. They know who the AV is, where she was, what her problems were and are. All the witnesses, including Kim, gave statements to the defense very early on.
I am very interested in a suggestion in an earlier post that Nifong has arrested the AV's brother and he is being held hostage to keep the AV from bailing out. Any backup on this?

Well I mean for anything other than menial labor or worse. As easy as it is to check a criminal record these days, anyone who doesn't deserves the employee they get.

I've heard that cops have stopped eating at places where they don't see the food prepared in front of them for just the reasons you mention.

OT: Well they make great resume' stuffers and that's about it. The funny thing is that they are all almost completely based on GPA so it's an all or nothing proposition. If an engineer takes enough social sciences and humanities he/she can get into Phi Beta Kappa as well. So a Mech. E. could simultaneously get into Phi Beta Kappa, Tau Beta Pi, and Pi Tau Sigma. Good grief - Greek letter overload.
